| 7 | 7 | | relating to authorizing the imposition of an additional courthouse |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Chapter 291, Local Government Code, is amended |
|---|
| 11 | 11 | | by adding Section 291.0091 to read as follows: |
|---|
| 12 | 12 | | Sec. 291.0091. ROBERTSON COUNTY SECURITY FEE. (a) In |
|---|
| 13 | 13 | | addition to any other fee authorized or required by other law, |
|---|
| 14 | 14 | | including a fee for security under Section 291.008, the Robertson |
|---|
| 15 | 15 | | County Commissioners Court may set a fee not to exceed $20 to be |
|---|
| 16 | 16 | | collected at the time of filing in each civil case filed in a |
|---|
| 17 | 17 | | district court, a county court at law, or the county court in |
|---|
| 18 | 18 | | Robertson County. The fee shall be taxed as other costs. The |
|---|
| 19 | 19 | | county is not liable for the costs. |
|---|
| 20 | 20 | | (b) In any civil case brought by the state or a political |
|---|
| 21 | 21 | | subdivision of the state in which the state or political |
|---|
| 22 | 22 | | subdivision is the prevailing party, the amount of a fee imposed |
|---|
| 23 | 23 | | under Subsection (a) shall be taxed and collected as a cost of court |
|---|
| 24 | 24 | | against each nonprevailing party. |
|---|
| 25 | 25 | | (c) The clerks of the respective courts shall collect the |
|---|
| 26 | 26 | | costs under this section. |
|---|
| 27 | 27 | | (d) A court clerk who collects costs under this section |
|---|
| 28 | 28 | | shall remit the collected amounts to the county treasurer, or to any |
|---|
| 29 | 29 | | other official who discharges the duties commonly delegated to the |
|---|
| 30 | 30 | | county treasurer, for deposit in a special fund to be used by the |
|---|
| 31 | 31 | | commissioners court only for courthouse security. |
|---|
| 32 | 32 | | SECTION 2. Subchapter D, Chapter 101, Government Code, is |
|---|
| 33 | 33 | | amended by adding Section 101.06151 to read as follows: |
|---|
| 34 | 34 | | Sec. 101.06151. ADDITIONAL DISTRICT COURT FEE FOR SECURITY: |
|---|
| 35 | 35 | | LOCAL GOVERNMENT CODE. The clerk of a district court in Robertson |
|---|
| 36 | 36 | | County shall collect an additional filing fee of not more than $20 |
|---|
| 37 | 37 | | under Section 291.0091, Local Government Code, in civil cases to |
|---|
| 38 | 38 | | fund courthouse security, if authorized by the county commissioners |
|---|
| 39 | 39 | | court. |
|---|
| 40 | 40 | | SECTION 3. Subchapter E, Chapter 101, Government Code, is |
|---|
| 41 | 41 | | amended by adding Section 101.08141 to read as follows: |
|---|
| 42 | 42 | | Sec. 101.08141. ADDITIONAL STATUTORY COUNTY COURT FEE FOR |
|---|
| 43 | 43 | | SECURITY: LOCAL GOVERNMENT CODE. The clerk of a statutory county |
|---|
| 44 | 44 | | court in Robertson County shall collect an additional filing fee of |
|---|
| 45 | 45 | | not more than $20 under Section 291.0091, Local Government Code, in |
|---|
| 46 | 46 | | civil cases to fund courthouse security, if authorized by the |
|---|
| 47 | 47 | | county commissioners court. |
|---|
| 48 | 48 | | SECTION 4. Subchapter F, Chapter 101, Government Code, is |
|---|
| 49 | 49 | | amended by adding Section 101.10131 to read as follows: |
|---|
| 50 | 50 | | Sec. 101.10131. ADDITIONAL STATUTORY PROBATE COURT FEE FOR |
|---|
| 51 | 51 | | SECURITY: LOCAL GOVERNMENT CODE. The clerk of a statutory probate |
|---|
| 52 | 52 | | court in Robertson County shall collect an additional filing fee of |
|---|
| 53 | 53 | | not more than $20 under Section 291.0091, Local Government Code, in |
|---|
| 54 | 54 | | civil cases to fund courthouse security, if authorized by the |
|---|
| 55 | 55 | | county commissioners court. |
|---|
| 56 | 56 | | SECTION 5. Subchapter G, Chapter 101, Government Code, is |
|---|
| 57 | 57 | | amended by adding Section 101.12141 to read as follows: |
|---|
| 58 | 58 | | Sec. 101.12141. ADDITIONAL COUNTY COURT FEE FOR SECURITY: |
|---|
| 59 | 59 | | LOCAL GOVERNMENT CODE. The clerk of the county court in Robertson |
|---|
| 60 | 60 | | County shall collect an additional filing fee of not more than $20 |
|---|
| 61 | 61 | | under Section 291.0091, Local Government Code, in civil cases to |
|---|
| 62 | 62 | | fund courthouse security, if authorized by the county commissioners |
|---|
| 63 | 63 | | court. |
|---|
| 64 | 64 | | SECTION 6. This Act takes effect September 1, 2019. |
|---|
