10 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 10 | | SECTION 1. Subchapter A, Chapter 101, Civil Practice and |
---|
12 | 11 | | Remedies Code, is amended by adding Section 101.004 to read as |
---|
13 | 12 | | follows: |
---|
14 | 13 | | Sec. 101.004. STATUS OF MEDICAL RESIDENTS AND FELLOWS. For |
---|
15 | 14 | | purposes of this chapter, a resident or fellow in a graduate medical |
---|
16 | 15 | | training program for physicians that is sponsored by a governmental |
---|
17 | 16 | | unit, including a medical and dental unit, as defined by Section |
---|
18 | 17 | | 61.003, Education Code, is considered to be an employee of a |
---|
19 | 18 | | governmental unit regardless of the method or source of payment of |
---|
20 | 19 | | the resident or fellow. |
---|
21 | 20 | | SECTION 2. This Act takes effect immediately if it receives |
---|
22 | 21 | | a vote of two-thirds of all the members elected to each house, as |
---|
23 | 22 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
24 | 23 | | Act does not receive the vote necessary for immediate effect, this |
---|
25 | 24 | | Act takes effect September 1, 2019. |
