76 AN ACT
87 relating to the status of certain medical residents and fellows as
98 governmental employees for purposes of the Texas Tort Claims Act.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. Subchapter A, Chapter 101, Civil Practice and
1211 Remedies Code, is amended by adding Section 101.004 to read as
1312 follows:
1413 Sec. 101.004. STATUS OF MEDICAL RESIDENTS AND FELLOWS. For
1514 purposes of this chapter, a resident or fellow in a graduate medical
1615 training program for physicians that is sponsored by a governmental
1716 unit, including a medical and dental unit, as defined by Section
1817 61.003, Education Code, is considered to be an employee of a
1918 governmental unit regardless of the method or source of payment of
2019 the resident or fellow.
2120 SECTION 2. This Act takes effect immediately if it receives
2221 a vote of two-thirds of all the members elected to each house, as
2322 provided by Section 39, Article III, Texas Constitution. If this
2423 Act does not receive the vote necessary for immediate effect, this
2524 Act takes effect September 1, 2019.
