66 AN ACT
77 relating to standards for expulsion policies of certain child-care
88 facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 42, Human Resources Code,
1111 is amended by adding Section 42.0429 to read as follows:
1212 Sec. 42.0429. POLICY ON EXPULSION. (a) Each day-care
1313 center, group day-care home, and listed or registered family home
1414 shall review the facility's policies to determine whether the
1515 facility has adopted a policy that addresses procedures for
1616 suspending or expelling a child from the facility.
1717 (b) If a facility described by Subsection (a) has not
1818 adopted an expulsion policy, the facility shall consider adopting a
1919 policy that describes the procedures the facility must follow
2020 before the facility may suspend or expel a child from the facility
2121 and that includes:
2222 (1) the procedures facility teachers and other
2323 personnel must follow when providing care to a child with
2424 behavioral issues;
2525 (2) the communications facility personnel must have
2626 with the child's family and caregivers; and
2727 (3) any referrals facility personnel may make to
2828 behavioral health specialists who may be available to address the
2929 child's behavioral issues.
3030 SECTION 2. This Act takes effect September 1, 2019.
