9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter C, Chapter 42, Human Resources Code, | |
11 | 11 | is amended by adding Section 42.0429 to read as follows: | |
12 | 12 | Sec. 42.0429. POLICY ON EXPULSION. (a) Each day-care | |
13 | 13 | center, group day-care home, and listed or registered family home | |
14 | 14 | shall review the facility's policies to determine whether the | |
15 | 15 | facility has adopted a policy that addresses procedures for | |
16 | 16 | suspending or expelling a child from the facility. | |
17 | 17 | (b) If a facility described by Subsection (a) has not | |
18 | 18 | adopted an expulsion policy, the facility shall consider adopting a | |
19 | 19 | policy that describes the procedures the facility must follow | |
20 | 20 | before the facility may suspend or expel a child from the facility | |
21 | 21 | and that includes: | |
22 | 22 | (1) the procedures facility teachers and other | |
23 | 23 | personnel must follow when providing care to a child with | |
24 | 24 | behavioral issues; | |
25 | 25 | (2) the communications facility personnel must have | |
26 | 26 | with the child's family and caregivers; and | |
27 | 27 | (3) any referrals facility personnel may make to | |
28 | 28 | behavioral health specialists who may be available to address the | |
29 | 29 | child's behavioral issues. | |
30 | 30 | SECTION 2. This Act takes effect September 1, 2019. |
