| 5 | 11 | | relating to the division of certain emergency services districts. |

| 6 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 13 | | SECTION 1. Section 775.221, Health and Safety Code, is |
|---|
| 8 | 14 | | amended to read as follows: |
|---|
| 9 | 15 | | Sec. 775.221. AUTHORITY TO DIVIDE DISTRICT. (a) This |
|---|
| 10 | 16 | | subchapter applies only to a district located wholly in: |
|---|
| 11 | 17 | | (1) a county with a population of 20,000 or less; or |
|---|
| 12 | 18 | | (2) a county with a population of more than 30,000 but |
|---|
| 13 | 19 | | less than 41,000 that is adjacent to a county with a population of |
|---|
| 14 | 20 | | more than 200,000 but less than 220,000. |
|---|
| 15 | 21 | | (b) The board of a district described by Subsection (a) |
|---|
| 16 | 22 | | [located wholly in one county with a population of 20,000 or less] |
|---|
| 17 | 23 | | may create a new district by disannexing territory from the |
|---|
| 18 | 24 | | existing district and ordering a new district to be created in the |
|---|
| 19 | 25 | | disannexed territory in the manner provided by this subchapter. |

| 20 | 26 | | SECTION 2. Section 775.223(c), Health and Safety Code, is |
|---|
| 21 | 27 | | amended to read as follows: |
|---|
| 22 | 28 | | (c) The [If the board finds that the petition contains the |
|---|
| 23 | 29 | | number of signatures required under Section 775.222(a), the] board |
|---|
| 24 | 30 | | shall approve the petition not later than the 10th day after the |
|---|
| 25 | 31 | | date of the hearing if the board finds that: |
|---|
| 26 | 32 | | (1) the petition contains the number of signatures |
|---|
| 27 | 33 | | required under Section 775.222(a); and |
|---|
| 28 | 34 | | (2) the proposed division is feasible. |
|---|
| 29 | 35 | | SECTION 3. The change in law made by this Act to Section |
|---|
| 30 | 36 | | 775.223(c), Health and Safety Code, applies only to the division of |
|---|
| 31 | 37 | | an emergency services district the petition for which is submitted |
|---|
| 32 | 38 | | on or after the effective date of this Act. The division of an |
|---|
| 33 | 39 | | emergency services district the petition for which is submitted |
|---|
| 34 | 40 | | before the effective date of this Act is governed by the law in |
|---|
| 35 | 41 | | effect on the date the petition is submitted, and the former law is |
|---|
| 36 | 42 | | continued in effect for that purpose. |

| 37 | 43 | | SECTION 4. This Act takes effect September 1, 2019. |
