55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the maritime port plans, reports, and programs prepared
88 by the Port Authority Advisory Committee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 55.007(a), Transportation Code, is
1111 amended to read as follows:
1212 (a) The committee shall:
1313 (1) prepare the [a] maritime port mission plan
1414 described by Section 55.008;
1515 (2) review each project eligible to be funded under
1616 this chapter and make recommendations for approval or disapproval
1717 to the department; and
1818 (3) [every two years prepare a report on Texas
1919 maritime ports, with a list of projects that have been recommended
2020 by the committee, including:
2121 [(A) the recommended funding level for each
2222 project; and
2323 [(B) if staged implementation of the project is
2424 appropriate, the funding requirements for each stage; and
2525 [(4)] advise the commission and the department on
2626 matters relating to port authorities.
2727 SECTION 2. Section 55.008, Transportation Code, is amended
2828 to read as follows:
2929 Sec. 55.008. MARITIME PORT MISSION PLAN [CAPITAL PROGRAM].
3030 (a) The committee shall prepare a two-year maritime port mission
3131 plan [capital program] defining the goals and objectives of the
3232 committee concerning the development of maritime port facilities
3333 and an intermodal transportation system. The plan [port capital
3434 program] must include projects or studies submitted to the
3535 committee by any maritime port and recommendations for:
3636 (1) the construction of transportation facilities
3737 connecting any maritime port to another transportation mode; and
3838 (2) the efficient, cost-effective development of
3939 transportation facilities or maritime port facilities for the
4040 purpose of:
4141 (A) enhancing international trade;
4242 (B) enhancing security;
4343 (C) promoting cargo flow;
4444 (D) increasing cruise passenger movements;
4545 (E) increasing maritime port revenues; and
4646 (F) providing economic benefits to the state.
4747 (b) The committee shall update the maritime port mission
4848 plan [capital program] and shall submit the updated plan [capital
4949 program] not later than December 1 of each even-numbered year to:
5050 (1) the governor;
5151 (2) the lieutenant governor;
5252 (3) the speaker of the house of representatives; and
5353 (4) the commission.
5454 SECTION 3. Section 55.007(b), Transportation Code, is
5555 repealed.
5656 SECTION 4. This Act takes effect immediately if it receives
5757 a vote of two-thirds of all the members elected to each house, as
5858 provided by Section 39, Article III, Texas Constitution. If this
5959 Act does not receive the vote necessary for immediate effect, this
6060 Act takes effect September 1, 2019.
