66 AN ACT
77 relating to the establishment of the Thirty Percent Texas
88 Initiative to encourage the use of food produced in this state for
99 school lunches.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 12, Agriculture Code, is amended by
1212 adding Section 12.0024 to read as follows:
1313 Sec. 12.0024. THIRTY PERCENT TEXAS INITIATIVE. (a) In this
1414 section:
1515 (1) "Initiative" means the Thirty Percent Texas
1616 Initiative under this section.
1717 (2) "School food authority" has the meaning assigned
1818 by 7 C.F.R. Section 210.2.
1919 (3) "School lunch program" means the program described
2020 by Section 12.0025(4).
2121 (b) A school food authority qualifies for the initiative in
2222 a state fiscal year if in the previous state fiscal year at least 30
2323 percent of the school food authority's total food costs for lunches
2424 served as part of the school lunch program were attributable to food
2525 items:
2626 (1) grown or harvested on land or from water in this
2727 state by means of agriculture, horticulture, aquaculture, or
2828 dairying; or
2929 (2) processed inside or outside this state if the
3030 processed food items consist of at least 51 percent of items
3131 described by Subdivision (1).
3232 (c) The value of United States Department of Agriculture
3333 commodity foods provided at no cost to a school food authority may
3434 not be considered for purposes of Subsection (b).
3535 (d) Using money appropriated for this purpose, the
3636 department shall distribute to a school food authority that
3737 qualifies for the initiative in a state fiscal year an amount equal
3838 to 25 cents per lunch served as part of the school lunch program
3939 during the state fiscal year, less the amount of any other state
4040 funds paid in connection with the lunch.
4141 SECTION 2. This Act takes effect September 1, 2019.
