| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 12, Agriculture Code, is amended by |
|---|
| 12 | 12 | | adding Section 12.0024 to read as follows: |
|---|
| 13 | 13 | | Sec. 12.0024. THIRTY PERCENT TEXAS INITIATIVE. (a) In this |
|---|
| 14 | 14 | | section: |
|---|
| 15 | 15 | | (1) "Initiative" means the Thirty Percent Texas |
|---|
| 16 | 16 | | Initiative under this section. |
|---|
| 17 | 17 | | (2) "School food authority" has the meaning assigned |
|---|
| 18 | 18 | | by 7 C.F.R. Section 210.2. |
|---|
| 19 | 19 | | (3) "School lunch program" means the program described |
|---|
| 20 | 20 | | by Section 12.0025(4). |
|---|
| 21 | 21 | | (b) A school food authority qualifies for the initiative in |
|---|
| 22 | 22 | | a state fiscal year if in the previous state fiscal year at least 30 |
|---|
| 23 | 23 | | percent of the school food authority's total food costs for lunches |
|---|
| 24 | 24 | | served as part of the school lunch program were attributable to food |
|---|
| 25 | 25 | | items: |
|---|
| 26 | 26 | | (1) grown or harvested on land or from water in this |
|---|
| 27 | 27 | | state by means of agriculture, horticulture, aquaculture, or |
|---|
| 28 | 28 | | dairying; or |
|---|
| 29 | 29 | | (2) processed inside or outside this state if the |
|---|
| 30 | 30 | | processed food items consist of at least 51 percent of items |
|---|
| 31 | 31 | | described by Subdivision (1). |
|---|
| 32 | 32 | | (c) The value of United States Department of Agriculture |
|---|
| 33 | 33 | | commodity foods provided at no cost to a school food authority may |
|---|
| 34 | 34 | | not be considered for purposes of Subsection (b). |
|---|
| 35 | 35 | | (d) Using money appropriated for this purpose, the |
|---|
| 36 | 36 | | department shall distribute to a school food authority that |
|---|
| 37 | 37 | | qualifies for the initiative in a state fiscal year an amount equal |
|---|
| 38 | 38 | | to 25 cents per lunch served as part of the school lunch program |
|---|
| 39 | 39 | | during the state fiscal year, less the amount of any other state |
|---|
| 40 | 40 | | funds paid in connection with the lunch. |
|---|
| 41 | 41 | | SECTION 2. This Act takes effect September 1, 2019. |
