55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the discipline and behavior management of a public
88 school student.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.0012, Education Code, is amended by
1111 adding Subsection (g) to read as follows:
1212 (g) If a student violates the student code of conduct
1313 adopted under Section 37.001, the campus behavior coordinator may:
1414 (1) create a behavior contract for the student stating
1515 that appropriate disciplinary action may be taken against the
1616 student as provided by the student code of conduct if the student
1717 continues to engage in the violative behavior; and
1818 (2) require the student and the student's parent or
1919 guardian to sign the contract as a condition of not taking immediate
2020 disciplinary action against the student.
2121 SECTION 2. Section 37.008(a), Education Code, is amended to
2222 read as follows:
2323 (a) Each school district shall provide a disciplinary
2424 alternative education program that:
2525 (1) is provided in a setting other than a student's
2626 regular classroom;
2727 (2) is located on or off of a regular school campus;
2828 (3) provides for the students who are assigned to the
2929 disciplinary alternative education program to be separated from
3030 students who are not assigned to the program;
3131 (4) focuses on English language arts, mathematics,
3232 science, history, and self-discipline;
3333 (5) provides for students' educational and behavioral
3434 needs, including by administering relevant behavioral assessments;
3535 (6) provides supervision and counseling; and
3636 (7) employs only teachers who meet all certification
3737 requirements established under Subchapter B, Chapter 21.
3838 SECTION 3. This Act applies beginning with the 2019-2020
3939 school year.
4040 SECTION 4. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2019.
