7 | 7 | | relating to the discipline and behavior management of a public |
---|
8 | 8 | | school student. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 37.0012, Education Code, is amended by |
---|
11 | 11 | | adding Subsection (g) to read as follows: |
---|
12 | 12 | | (g) If a student violates the student code of conduct |
---|
13 | 13 | | adopted under Section 37.001, the campus behavior coordinator may: |
---|
14 | 14 | | (1) create a behavior contract for the student stating |
---|
15 | 15 | | that appropriate disciplinary action may be taken against the |
---|
16 | 16 | | student as provided by the student code of conduct if the student |
---|
17 | 17 | | continues to engage in the violative behavior; and |
---|
18 | 18 | | (2) require the student and the student's parent or |
---|
19 | 19 | | guardian to sign the contract as a condition of not taking immediate |
---|
20 | 20 | | disciplinary action against the student. |
---|
21 | 21 | | SECTION 2. Section 37.008(a), Education Code, is amended to |
---|
22 | 22 | | read as follows: |
---|
23 | 23 | | (a) Each school district shall provide a disciplinary |
---|
24 | 24 | | alternative education program that: |
---|
25 | 25 | | (1) is provided in a setting other than a student's |
---|
26 | 26 | | regular classroom; |
---|
27 | 27 | | (2) is located on or off of a regular school campus; |
---|
28 | 28 | | (3) provides for the students who are assigned to the |
---|
29 | 29 | | disciplinary alternative education program to be separated from |
---|
30 | 30 | | students who are not assigned to the program; |
---|
31 | 31 | | (4) focuses on English language arts, mathematics, |
---|
32 | 32 | | science, history, and self-discipline; |
---|
33 | 33 | | (5) provides for students' educational and behavioral |
---|
34 | 34 | | needs, including by administering relevant behavioral assessments; |
---|
35 | 35 | | (6) provides supervision and counseling; and |
---|
36 | 36 | | (7) employs only teachers who meet all certification |
---|
37 | 37 | | requirements established under Subchapter B, Chapter 21. |
---|
38 | 38 | | SECTION 3. This Act applies beginning with the 2019-2020 |
---|
39 | 39 | | school year. |
---|
40 | 40 | | SECTION 4. This Act takes effect immediately if it receives |
---|
41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
---|
42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
---|
44 | 44 | | Act takes effect September 1, 2019. |
