66 AN ACT
77 relating to repayment of certain mental health professional
88 education loans.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 61.601, Education Code, as amended by
1111 Chapters 891 (H.B. 3083) and 1101 (H.B. 3808), Acts of the 85th
1212 Legislature, Regular Session, 2017, is reenacted and amended to
1313 read as follows:
1414 Sec. 61.601. DEFINITION. In this subchapter, "mental
1515 health professional" means:
1616 (1) a licensed physician who is:
1717 (A) a graduate of an accredited psychiatric
1818 residency training program; or
1919 (B) certified in psychiatry by:
2020 (i) the American Board of Psychiatry and
2121 Neurology; or
2222 (ii) the American Osteopathic Board of
2323 Neurology and Psychiatry;
2424 (2) a psychologist, as defined by Section 501.002,
2525 Occupations Code;
2626 (3) a licensed professional counselor, as defined by
2727 Section 503.002, Occupations Code;
2828 (4) an advanced practice registered nurse, as defined
2929 by Section 301.152, Occupations Code, who holds a nationally
3030 recognized board certification in psychiatric or mental health
3131 nursing;
3232 (5) a licensed clinical social worker, as defined by
3333 Section 505.002, Occupations Code; [and]
3434 (6) a chemical dependency counselor, as defined by
3535 Section 504.001, Occupations Code;
3636 (7) [(6)] a licensed marriage and family therapist, as
3737 defined by Section 502.002, Occupations Code; and
3838 (8) a licensed specialist in school psychology, as
3939 defined by Section 501.002, Occupations Code.
4040 SECTION 2. Section 61.603, Education Code, is amended to
4141 read as follows:
4242 Sec. 61.603. ELIGIBILITY. (a) Except as provided by
4343 Subsection (b), to [To] be eligible to receive repayment assistance
4444 under this subchapter, a mental health professional must:
4545 (1) apply to the board;
4646 (2) have completed one, two, three, four, or five
4747 consecutive years of practice in a mental health professional
4848 shortage area designated by the Department of State Health
4949 Services; and
5050 (3) provide mental health services in this state to:
5151 (A) recipients under the medical assistance
5252 program authorized by Chapter 32, Human Resources Code;
5353 (B) enrollees under the child health plan program
5454 authorized by Chapter 62, Health and Safety Code; or
5555 (C) persons committed to a secure correctional
5656 facility operated by or under contract with the Texas Juvenile
5757 Justice Department or persons confined in a secure correctional
5858 facility operated by or under contract with any division of the
5959 Texas Department of Criminal Justice.
6060 (b) To be eligible to receive repayment assistance under
6161 this subchapter, a mental health professional described by Section
6262 61.601(8) who is employed by a school district or open-enrollment
6363 charter school must:
6464 (1) apply to the board;
6565 (2) provide mental health services to students
6666 enrolled in a school district or open-enrollment charter school;
6767 and
6868 (3) have completed one, two, three, four, or five
6969 consecutive years of practice in this state as described by
7070 Subdivision (2).
7171 (c) In addition to satisfying the requirements under
7272 Subsection (a), for a licensed physician to be eligible to receive
7373 repayment assistance under this subchapter after the physician's
7474 third consecutive year of practice described under Subsection
7575 (a)(2), the physician must be certified in psychiatry by:
7676 (1) the American Board of Psychiatry and Neurology; or
7777 (2) the American Osteopathic Board of Neurology and
7878 Psychiatry.
7979 SECTION 3. Sections 61.604(d) and (e), Education Code, as
8080 added by Chapter 1101 (H.B. 3808), Acts of the 85th Legislature,
8181 Regular Session, 2017, are amended to read as follows:
8282 (d) The board may award a grant under this subchapter to a
8383 mental health professional described by Section 61.601(7) or (8)
8484 [61.601(6)] only in accordance with Subsection (e).
8585 (e) If in a state fiscal year there are funds available for
8686 purposes of the program after funding grants to all eligible mental
8787 health professionals described by Sections [Subsections]
8888 61.601(1)-(6) [61.601(1)-(5)], the board may allocate any unused
8989 funds to award repayment assistance grants to mental health
9090 professionals in any of the professions listed in Section 61.601
9191 except that priority must be given to awarding grants to mental
9292 health professionals described by Sections [Subsections]
9393 61.601(1)-(6) [61.601(1)-(5)]. The limitations prescribed by
9494 Subsections (b) and (c) do not apply to grants awarded under this
9595 subsection.
9696 SECTION 4. Section 61.607(b), Education Code, as amended by
9797 Chapters 891 (H.B. 3083) and 1101 (H.B. 3808), Acts of the 85th
9898 Legislature, Regular Session, 2017, is reenacted and amended to
9999 read as follows:
100100 (b) The total amount of repayment assistance received by a
101101 mental health professional under this subchapter may not exceed:
102102 (1) $160,000, for assistance from the state received
103103 by a licensed physician;
104104 (2) $80,000, for assistance from the state received
105105 by:
106106 (A) a psychologist;
107107 (B) a licensed clinical social worker, if the
108108 social worker has received a doctoral degree related to social
109109 work;
110110 (C) a licensed professional counselor, if the
111111 counselor has received a doctoral degree related to counseling; or
112112 (D) a licensed marriage and family therapist, if
113113 the marriage and family therapist has received a doctoral degree
114114 related to marriage and family therapy;
115115 (3) $60,000, for assistance from the state received by
116116 an advanced practice registered nurse;
117117 (4) $40,000, for assistance from the state received by
118118 a licensed clinical social worker, a licensed marriage and family
119119 therapist, or a licensed professional counselor who is not
120120 described by Subdivision (2); and
121121 (5) $10,000, for assistance from the state received
122122 by:
123123 (A) a licensed chemical dependency counselor, if
124124 the chemical dependency counselor has received an associate degree
125125 related to chemical dependency counseling or behavioral science; or
126126 (B) a licensed specialist in school psychology.
127127 SECTION 5. The following provisions are repealed:
128128 (1) Section 61.604(d), Education Code, as added by
129129 Chapter 891 (H.B. 3083), Acts of the 85th Legislature, Regular
130130 Session, 2017; and
131131 (2) Section 61.608(c), Education Code, as added by
132132 Chapter 891 (H.B. 3083), Acts of the 85th Legislature, Regular
133133 Session, 2017.
134134 SECTION 6. To the extent of any conflict, this Act prevails
135135 over another Act of the 86th Legislature, Regular Session, 2019,
136136 relating to nonsubstantive additions to and corrections in enacted
137137 codes.
138138 SECTION 7. This Act takes effect September 1, 2019.
