117 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12- SECTION 1. Section 503.061(a), Transportation Code, is
13- amended to read as follows:
14- (a) Instead of registering under Chapter 502 a vehicle that
15- the dealer owns, operates, or permits to be operated on a public
16- street or highway, the dealer may apply for, receive, and attach
17- metal dealer's license plates, including dealer specialty license
18- plate designs issued under Section 504.517, to the vehicle if it is
19- the type of vehicle:
8+ SECTION 1. Section 503.061, Transportation Code, is amended
9+ to read as follows:
10+ Sec. 503.061. DEALER'S LICENSE PLATES. (a) Instead of
11+ registering under Chapter 502 a vehicle that the dealer owns,
12+ operates, or permits to be operated on a public street or highway,
13+ the dealer may apply for, receive, and attach metal dealer's
14+ license plates, including specialty plates issued in accordance
15+ with Chapter 504, Subchapter J, Transportation Code, to the vehicle
16+ if it is the type of vehicle:
2017 (1) that the dealer sells; and
2118 (2) for which the dealer has been issued a general
2219 distinguishing number.
23- SECTION 2. Section 503.0615, Transportation Code, is
24- amended by adding Subsection (g) to read as follows:
25- (g) In this section, "personalized prestige dealer's
26- license plate" includes a dealer specialty license plate design
27- issued under Section 504.517.
20+ (b) The board may adopt rules regulating the issuance and
21+ use of a license plate issued pursuant to the terms of this section.
22+ SECTION 2. Section 503.615, Transportation Code, is amended
23+ to read as follows:
24+ Sec. 503.0615. PERSONALIZED PRESTIGE DEALER'S LICENSE
25+ PLATES. (a) The department shall establish and issue personalized
26+ prestige dealer's license plates. The department may not issue
27+ identically lettered or numbered dealer's plates to more than one
28+ dealer.
29+ (b) The department shall establish procedures for
30+ continuous application for and issuance of personalized prestige
31+ dealer's license plates. A dealer must make a new application and
32+ pay a new fee for each registration period for which the dealer
33+ seeks to obtain personalized prestige dealer's license plates. A
34+ dealer who obtains personalized prestige dealer's license plates
35+ has first priority on those plates for each subsequent registration
36+ period for which the dealer applies.
37+ (c) The annual fee for personalized prestige dealer's
38+ license plates is $40, in addition to any fee otherwise prescribed
39+ by this chapter.
40+ (d) The department may issue to an applicant only one set of
41+ personalized prestige dealer's license plates for a vehicle for a
42+ six-year period. The department may issue a new set of personalized
43+ prestige dealer's license plates within the six-year period if the
44+ applicant pays a fee of $50 in addition to the fees required by
45+ Subsection (c).
46+ (e) On application and payment of the required fee for a
47+ registration period following the issuance of the plates, the
48+ department shall issue a registration insignia.
49+ (f) Of each fee collected by the department under this
50+ section:
51+ (1) $1.25 shall be deposited to the credit of the Texas
52+ Department of Motor Vehicles fund to defray the cost of
53+ administering this section; and
54+ (2) the remainder shall be deposited to the credit of
55+ the general revenue fund.
56+ (g) For purposes of this section, "personalized prestige
57+ dealer license plate(s)" shall include three specialty plate
58+ designs, as designated by the private vendor, authorized and issued
59+ in accordance with Chapter 504, Subchapter J, Transportation Code.
2860 Section 3. Section 504.401, Transportation Code, is amended
29- by adding Subsection (e) to read as follows:
30- (e) Specialty license plates issued to a state official
31- under this section include specialty license plates issued under
32- Subchapter J.
33- SECTION 4. Subchapter F, Chapter 504, Transportation Code,
34- is amended by adding Section 504.517 to read as follows:
35- Sec. 504.517. DEALER SPECIALTY LICENSE PLATES. (a) The
36- department shall issue specialty:
37- (1) metal dealer's license plates for use in
38- accordance with Section 503.061; and
39- (2) personalized prestige dealer's plates for use in
40- accordance with Section 503.0615.
41- (b) The department shall issue not more than three specialty
42- license plate designs under this section. License plates issued
43- under this section must include the word "Dealer" at the bottom of
44- each plate.
45- (c) The fee for issuance of the license plates is $30. In
46- addition to the fee under this subsection, personalized prestige
47- dealer's plates are subject to the fee under Section 503.0615(c).
48- SECTION 5. Section 504.851(a-1), Transportation Code, is
49- amended to read as follows:
50- (a-1) Except as otherwise provided by this subsection, the
51- [The] department may not issue specialty, personalized, or souvenir
52- license plates with background colors other than white, unless the
53- plates are marketed and sold by the private vendor. The department
54- may issue dealer specialty license plates under Section 504.517
55- with background colors other than white.
56- SECTION 6. This Act takes effect September 1, 2019.

62+ Sec. 504.401. STATE OFFICIALS. (a) The department shall
63+ issue specialty license plates to a state official.
64+ (b) Repealed by Acts 2011, 82nd Leg., R.S., Ch. 1296, Sec.
65+ 247(11), eff. January 1, 2012.
66+ (c) The registration remains valid until December 31 of each
67+ year.
68+ (d) In this section, "state official" means:
69+ (1) a member of the legislature;
70+ (2) the governor;
71+ (3) the lieutenant governor;
72+ (4) a justice of the supreme court;
73+ (5) a judge of the court of criminal appeals;
74+ (6) the attorney general;
75+ (7) the commissioner of the General Land Office;
76+ (8) the comptroller;
77+ (9) a member of the Railroad Commission of Texas;
78+ (10) the commissioner of agriculture;
79+ (11) the secretary of state; or
80+ (12) a member of the State Board of Education.
81+ (e) For purposes of this section, "specialty license
82+ plates" shall include plate designs authorized and issued in
83+ accordance with Chapter 504, Subchapter J, Transportation Code.
84+ Section 4. This Act takes effect on September 1, 2019.
