| 7 | 7 | | relating to the prosecution of the criminal offense of improper |

| 8 | 8 | | relationship between educator and student. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 21.01(2), Penal Code, is amended to read |
|---|
| 11 | 11 | | as follows: |
|---|
| 12 | 12 | | (2) "Sexual contact" means, except as provided by |
|---|
| 13 | 13 | | Section 21.11 or 21.12, any touching of the anus, breast, or any |
|---|
| 14 | 14 | | part of the genitals of another person with intent to arouse or |
|---|
| 15 | 15 | | gratify the sexual desire of any person. |
|---|
| 16 | 16 | | SECTION 2. Section 21.12, Penal Code, is amended by adding |
|---|
| 17 | 17 | | Subsection (e) to read as follows: |
|---|
| 18 | 18 | | (e) In this section, "sexual contact" means the following |
|---|
| 19 | 19 | | acts, if committed with the intent to arouse or gratify the sexual |
|---|
| 20 | 20 | | desire of any person: |
|---|
| 21 | 21 | | (1) any touching by an employee of a public or private |
|---|
| 22 | 22 | | primary or secondary school of the anus, breast, or any part of the |
|---|
| 23 | 23 | | genitals of a person enrolled in a public or private primary or |
|---|
| 24 | 24 | | secondary school; or |
|---|
| 25 | 25 | | (2) any touching of any part of the body of a person |
|---|
| 26 | 26 | | enrolled in a public or private primary or secondary school with the |
|---|
| 27 | 27 | | anus, breast, or any part of the genitals of an employee of a public |
|---|
| 28 | 28 | | or private primary or secondary school. |
|---|
| 29 | 29 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 30 | 30 | | to an offense committed on or after the effective date of this Act. |
|---|
| 31 | 31 | | An offense committed before the effective date of this Act is |
|---|
| 32 | 32 | | governed by the law in effect on the date the offense was committed, |
|---|
| 33 | 33 | | and the former law is continued in effect for that purpose. For |
|---|
| 34 | 34 | | purposes of this section, an offense was committed before the |
|---|
| 35 | 35 | | effective date of this Act if any element of the offense was |
|---|
| 36 | 36 | | committed before that date. |
|---|
| 37 | 37 | | SECTION 4. This Act takes effect September 1, 2019. |
