66 AN ACT
77 relating to signature verification on an early voting ballot voted
88 by mail.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 87.027, Election Code, is amended by
1111 adding Subsection (i-1) to read as follows:
1212 (i-1) In making the determination under Subsection (i), the
1313 Signature Verification committee may only determine whether the
1414 handwriting on the certificate and application indicates that the
1515 same person executed both signatures. The committee may not
1616 determine that two signatures were not executed by the same person
1717 on the basis of which version of the same name the person used,
1818 including:
1919 (1) the inclusion of a middle name or initial in one
2020 signature that is omitted in the other;
2121 (2) the use of a common nickname in one signature and a
2222 formal name in the other; or
2323 (3) a variation between the two signatures of the
2424 order of the person's first, middle, and last name.
2525 SECTION 2. Section 87.041, Election Code, is amended by
2626 adding Subsection (h) to read as follows:
2727 (h) In making the determination under Subsection (b)(2),
2828 the board may only determine whether the handwriting on the
2929 certificate and application indicates that the same person executed
3030 both signatures. The board may not determine that two signatures
3131 were not executed by the same person on the basis of which version
3232 of the same name the person used, including:
3333 (1) the inclusion of a middle name or initial in one
3434 signature that is omitted in the other;
3535 (2) the use of a common nickname in one signature and a
3636 formal name in the other; or
3737 (3) a variation between the two signatures of the
3838 order of the person's first, middle, and last name.
3939 SECTION 3. This Act takes effect September 1, 2019.
