55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the eligibility of an individual to be an employee of an
88 appraisal district or to serve on the board of directors of an
99 appraisal district.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 6.03(a), Tax Code, is amended to read as
1212 follows:
1313 (a) The appraisal district is governed by a board of
1414 directors. Five directors are appointed by the taxing units that
1515 participate in the district as provided by this section. If the
1616 county assessor-collector is not appointed to the board, the county
1717 assessor-collector serves as a nonvoting director. The county
1818 assessor-collector is ineligible to serve if the board enters into
1919 a contract under Section 6.05(b) or if the commissioners court of
2020 the county enters into a contract under Section 6.24(b). To be
2121 eligible to serve on the board of directors, an individual other
2222 than a county assessor-collector serving as a nonvoting director
2323 must be a resident of the district and must have resided in the
2424 district for at least two years immediately preceding the date the
2525 individual takes office. Except as provided by this subsection, an
2626 [An] individual [who] is ineligible [otherwise eligible] to serve
2727 on the board if the individual is an officer or employee [is not
2828 ineligible because of membership on the governing body of a taxing
2929 unit. An employee] of a taxing unit that participates in the
3030 district [is not eligible to serve on the board unless the
3131 individual is also a member of the governing body or an elected
3232 official of a taxing unit that participates in the district].
3333 SECTION 2. Subchapter A, Chapter 6, Tax Code, is amended by
3434 adding Section 6.054 to read as follows:
3535 Sec. 6.054. RESTRICTION ON EMPLOYMENT BY APPRAISAL
3636 DISTRICT. An individual may not be employed by an appraisal
3737 district if the individual is:
3838 (1) an officer of a taxing unit that participates in
3939 the appraisal district; or
4040 (2) an employee of a taxing unit that participates in
4141 the appraisal district.
4242 SECTION 3. Section 6.03(a), Tax Code, as amended by this
4343 Act, does not affect the right of a person serving on the board of
4444 directors of an appraisal district on the effective date of this Act
4545 to complete the person's term on the board.
4646 SECTION 4. This Act takes effect January 1, 2020.
