44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the protection of an employee of an open-enrollment
77 charter school who reports a violation of law.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 554.001, Government Code, is amended to
1010 read as follows:
1111 Sec. 554.001. DEFINITIONS. In this chapter:
1212 (1) "Law" means:
1313 (A) a state or federal statute;
1414 (B) an ordinance of a local governmental entity;
1515 or
1616 (C) a rule adopted under a statute or ordinance.
1717 (2) "Local governmental entity" means a political
1818 subdivision of the state, including [a]:
1919 (A) a county;
2020 (B) a municipality;
2121 (C) a public school district; [or]
2222 (D) a special-purpose district or authority; or
2323 (E) an open-enrollment charter school.
2424 (3) "Personnel action" means an action that affects a
2525 public employee's compensation, promotion, demotion, transfer,
2626 work assignment, or performance evaluation.
2727 (4) "Public employee" means an employee or appointed
2828 officer other than an independent contractor who is paid to perform
2929 services for a state or local governmental entity.
3030 (5) "State governmental entity" means:
3131 (A) a board, commission, department, office, or
3232 other agency in the executive branch of state government, created
3333 under the constitution or a statute of the state, including an
3434 institution of higher education, as defined by Section 61.003,
3535 Education Code;
3636 (B) the legislature or a legislative agency; or
3737 (C) the Texas Supreme Court, the Texas Court of
3838 Criminal Appeals, a court of appeals, a state judicial agency, or
3939 the State Bar of Texas.
4040 SECTION 2. The changes in law made by this Act apply to a
4141 suspension or termination of employment of a public employee or to
4242 other adverse personnel action taken against an employee on or
4343 after the effective date of this Act. A suspension or termination
4444 of employment of a public employee or other adverse personnel
4545 action against the employee that is take before the effective date
4646 of this Act is governed by the law existing on the date the
4747 suspension, termination, or other adverse personnel action
4848 occurred, and the former law is continued in effect for that
4949 purpose.
5050 SECTION 3. This Act takes effect September 1, 2019.
