76 AN ACT
87 relating to fees charged to students enrolled at component
98 institutions of The Texas A&M University System.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. Section 54.5032(a), Education Code, is amended
1211 to read as follows:
1312 (a) A student fee advisory committee is established at each
1413 component institution of The Texas A&M University System to advise
1514 the board of regents and the administration of the institution on
1615 the type, amount, and expenditure of compulsory fees for student
1716 services under Section 54.503, for student [health and] medical
1817 services under Section 54.507, for student center facilities under
1918 Section 54.521, and for recreational sports under Section 54.539.
2019 SECTION 2. The heading to Section 54.507, Education Code,
2120 is amended to read as follows:
2221 Sec. 54.507. STUDENT [GROUP HOSPITAL AND] MEDICAL SERVICES
2322 FEES; THE TEXAS A&M UNIVERSITY SYSTEM.
2423 SECTION 3. Sections 54.507(a), (b), (c), and (f), Education
2524 Code, are amended to read as follows:
2625 (a) The Board of Regents of The Texas A&M University System
2726 may levy and collect from each student at any institution of higher
2827 education which is a part of The Texas A&M University System a
2928 compulsory student [group hospital and] medical services fee not to
3029 exceed $200 [$75] for each regular semester and not to exceed $100
3130 [$25] for each term of each summer session. The compulsory student
3231 [group hospital and] medical services fee may not be levied unless
3332 the levy of the fee has been approved by a majority vote of those
3433 students at the affected institution participating in a general
3534 student election called for that purpose.
3635 (b) In addition to the fee authorized under Subsection (a)
3736 [of this section], the Board of Regents of The Texas A&M University
3837 System may levy and collect from each student registered at Prairie
3938 View A&M University a supplemental student [group hospital and]
4039 medical services fee not to exceed $30 for each regular semester and
4140 not to exceed $12.50 for each term of the summer session. The
4241 supplemental student [group hospital and] medical services fee may
4342 not be levied unless the levy of the fee has been approved by a
4443 majority vote of the students registered at Prairie View A&M
4544 University participating in a general election called for that
4645 purpose.
4746 (c) A fee levied under this section at a component
4847 institution of The Texas A&M University System may be used only to
4948 finance, construct, operate, renovate, maintain, or improve new or
5049 existing student medical facilities or provide [hospital or other]
5150 medical services to students registered at that component
5251 institution.
5352 (f) An election under this section must also permit the
5453 students to vote on whether student [hospital and] medical services
5554 should be provided to students at the institution by the
5655 institution or by a private entity. The vote by the students on the
5756 responsibility for provision of student [hospital and] medical
5857 services to students at the institution is not binding on the
5958 institution.
6059 SECTION 4. Sections 54.521(a) and (e), Education Code, are
6160 amended to read as follows:
6261 (a) The board of regents of The Texas A&M University System
6362 may levy a regular, fixed student fee on each student enrolled in an
6463 educational institution within The Texas A&M University System for
6564 the purpose of acquiring, constructing, renovating, operating,
6665 maintaining, improving, adding to, replacing, financing, and
6766 equipping one or more student center facilities for the
6867 institution. The board may set fees in amounts it considers just and
6968 necessary but not to exceed $200 [$100] per student for each
7069 semester for the long session and not to exceed $100 [$50] per
7170 student for each term of the summer session, or any fractional part
7271 of a session. The activities of a student center facility that may
7372 be financed in whole or in part by the student center facility fee
7473 are limited to those activities in which the entire student body is
7574 eligible to participate. The financed activities may not be held
7675 outside the territorial limits of any educational institution
7776 within The Texas A&M University System.
7877 (e) The amount of the fee authorized by this section may not
7978 be increased from one academic year to the next by 10 percent or
8079 more, unless the increase has been approved by a majority vote of
8180 the students at the affected institution participating in a general
8281 election called for that purpose or, if the amount of the fee
8382 increase does not exceed 10 percent, the amount of the fee increase
8483 has been approved by a majority vote of the board of regents taken
8584 at a board meeting on the increase after giving students an
8685 opportunity for public comment on the increase [except that at
8786 Tarleton State University the fee may be increased by not more than
8887 10 percent from one academic year to the next without holding an
8988 election]. The fee may not exceed the maximum amounts provided by
9089 Subsection (a).
9190 SECTION 5. Sections 54.507 and 54.521, Education Code, as
9291 amended by this Act, apply beginning with fees charged for the
9392 2019-2020 academic year. A fee charged in an academic year before
9493 that academic year is covered by the law in effect before the
9594 effective date of this Act, and the former law is continued in
9695 effect for that purpose.
9796 SECTION 6. This Act takes effect immediately if it receives
9897 a vote of two-thirds of all the members elected to each house, as
9998 provided by Section 39, Article III, Texas Constitution. If this
10099 Act does not receive the vote necessary for immediate effect, this
101100 Act takes effect September 1, 2019.
