55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the confidentiality of certain home address information
88 in ad valorem tax appraisal records.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 25.025(a), Tax Code, as amended by
1111 Chapters 34 (S.B. 1576), 41 (S.B. 256), 193 (S.B. 510), 1006 (H.B.
1212 1278), and 1145 (H.B. 457), Acts of the 85th Legislature, Regular
1313 Session, 2017, is reenacted and amended to read as follows:
1414 (a) This section applies only to:
1515 (1) a current or former peace officer as defined by
1616 Article 2.12, Code of Criminal Procedure, and the spouse or
1717 surviving spouse of the peace officer;
1818 (2) the adult child of a current peace officer as
1919 defined by Article 2.12, Code of Criminal Procedure;
2020 (3) a county jailer as defined by Section 1701.001,
2121 Occupations Code;
2222 (4) an employee of the Texas Department of Criminal
2323 Justice;
2424 (5) a commissioned security officer as defined by
2525 Section 1702.002, Occupations Code;
2626 (6) an individual who shows that the individual, the
2727 individual's child, or another person in the individual's household
2828 is a victim of family violence as defined by Section 71.004, Family
2929 Code, by providing:
3030 (A) a copy of a protective order issued under
3131 Chapter 85, Family Code, or a magistrate's order for emergency
3232 protection issued under Article 17.292, Code of Criminal Procedure;
3333 or
3434 (B) other independent documentary evidence
3535 necessary to show that the individual, the individual's child, or
3636 another person in the individual's household is a victim of family
3737 violence;
3838 (7) [(6)] an individual who shows that the individual,
3939 the individual's child, or another person in the individual's
4040 household is a victim of sexual assault or abuse, stalking, or
4141 trafficking of persons by providing:
4242 (A) a copy of a protective order issued under
4343 Chapter 7A or Article 6.09, Code of Criminal Procedure, or a
4444 magistrate's order for emergency protection issued under Article
4545 17.292, Code of Criminal Procedure; or
4646 (B) other independent documentary evidence
4747 necessary to show that the individual, the individual's child, or
4848 another person in the individual's household is a victim of sexual
4949 assault or abuse, stalking, or trafficking of persons;
5050 (8) [(7)] a participant in the address
5151 confidentiality program administered by the attorney general under
5252 Subchapter C, Chapter 56, Code of Criminal Procedure, who provides
5353 proof of certification under Article 56.84, Code of Criminal
5454 Procedure;
5555 (9) [(8)] a federal judge, a state judge, or the
5656 spouse of a federal judge or state judge;
5757 (10) a current or former district attorney, criminal
5858 district attorney, or county or municipal attorney whose
5959 jurisdiction includes any criminal law or child protective services
6060 matters;
6161 (11) [(9)] a current or former employee of a district
6262 attorney, criminal district attorney, or county or municipal
6363 attorney whose jurisdiction includes any criminal law or child
6464 protective services matters;
6565 (12) [(10)] an officer or employee of a community
6666 supervision and corrections department established under Chapter
6767 76, Government Code, who performs a duty described by Section
6868 76.004(b) of that code;
6969 (13) [(11)] a criminal investigator of the United
7070 States as described by Article 2.122(a), Code of Criminal
7171 Procedure;
7272 (14) [(12)] a police officer or inspector of the
7373 United States Federal Protective Service;
7474 (15) [(13)] a current or former United States attorney
7575 or assistant United States attorney and the spouse and child of the
7676 attorney;
7777 (16) [(14)] a current or former employee of the office
7878 of the attorney general who is or was assigned to a division of that
7979 office the duties of which involve law enforcement;
8080 (17) [(15)] a medical examiner or person who performs
8181 forensic analysis or testing who is employed by this state or one or
8282 more political subdivisions of this state;
8383 (18) [(16)] a current or former member of the United
8484 States armed forces who has served in an area that the president of
8585 the United States by executive order designates for purposes of 26
8686 U.S.C. Section 112 as an area in which armed forces of the United
8787 States are or have engaged in combat;
8888 (19) [(17)] a current or former employee of the Texas
8989 Juvenile Justice Department or of the predecessors in function of
9090 the department;
9191 (20) [(18)] a current or former juvenile probation or
9292 supervision officer certified by the Texas Juvenile Justice
9393 Department, or the predecessors in function of the department,
9494 under Title 12, Human Resources Code;
9595 (21) [(19)] a current or former employee of a juvenile
9696 justice program or facility, as those terms are defined by Section
9797 261.405, Family Code; [and]
9898 (22) [(18)] a current or former employee of the Texas
9999 Civil Commitment Office or the predecessor in function of the
100100 office or a division of the office;
101101 (23) [(18)] a current or former employee of a federal
102102 judge or state judge; and
103103 (24) an employee of or volunteer or contractor for a
104104 clinic or facility that provides abortion or family planning
105105 services.
106106 SECTION 2. To the extent of any conflict, this Act prevails
107107 over another Act of the 86th Legislature, Regular Session, 2019,
108108 relating to nonsubstantive additions to and corrections in enacted
109109 codes.
110110 SECTION 3. This Act takes effect September 1, 2019.
