66 AN ACT
77 relating to Medicaid reimbursement for medication-assisted
88 treatment for opioid or substance use disorder.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1111 is amended by adding Section 32.03115 to read as follows:
1212 Sec. 32.03115. REIMBURSEMENT FOR MEDICATION-ASSISTED
1313 TREATMENT FOR OPIOID OR SUBSTANCE USE DISORDER. (a) In this
1414 section, "medication-assisted opioid or substance use disorder
1515 treatment" means the use of methadone, buprenorphine, or naltrexone
1616 to treat opioid or substance use disorder.
1717 (b) Notwithstanding Sections 531.072 and 531.073,
1818 Government Code, or any other law and subject to Subsection (c), the
1919 commission shall provide medical assistance reimbursement for
2020 medication-assisted opioid or substance use disorder treatment
2121 without requiring a recipient of medical assistance or health care
2222 provider to obtain prior authorization or precertification for the
2323 treatment.
2424 (c) The commission may provide medical assistance
2525 reimbursement for medication-assisted opioid or substance use
2626 disorder treatment only if the treatment is prescribed to a
2727 recipient of medical assistance by a licensed health care provider
2828 who is authorized to prescribe methadone, buprenorphine, or
2929 naltrexone.
3030 SECTION 2. If before implementing any provision of this Act
3131 a state agency determines that a waiver or authorization from a
3232 federal agency is necessary for implementation of that provision,
3333 the agency affected by the provision shall request the waiver or
3434 authorization and may delay implementing that provision until the
3535 waiver or authorization is granted.
3636 SECTION 3. This Act takes effect September 1, 2019.
