| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 32, Human Resources Code, |
|---|
| 11 | 11 | | is amended by adding Section 32.03115 to read as follows: |
|---|
| 12 | 12 | | Sec. 32.03115. REIMBURSEMENT FOR MEDICATION-ASSISTED |
|---|
| 13 | 13 | | TREATMENT FOR OPIOID OR SUBSTANCE USE DISORDER. (a) In this |
|---|
| 14 | 14 | | section, "medication-assisted opioid or substance use disorder |
|---|
| 15 | 15 | | treatment" means the use of methadone, buprenorphine, or naltrexone |
|---|
| 16 | 16 | | to treat opioid or substance use disorder. |
|---|
| 17 | 17 | | (b) Notwithstanding Sections 531.072 and 531.073, |
|---|
| 18 | 18 | | Government Code, or any other law and subject to Subsection (c), the |
|---|
| 19 | 19 | | commission shall provide medical assistance reimbursement for |
|---|
| 20 | 20 | | medication-assisted opioid or substance use disorder treatment |
|---|
| 21 | 21 | | without requiring a recipient of medical assistance or health care |
|---|
| 22 | 22 | | provider to obtain prior authorization or precertification for the |
|---|
| 23 | 23 | | treatment. |
|---|
| 24 | 24 | | (c) The commission may provide medical assistance |
|---|
| 25 | 25 | | reimbursement for medication-assisted opioid or substance use |
|---|
| 26 | 26 | | disorder treatment only if the treatment is prescribed to a |
|---|
| 27 | 27 | | recipient of medical assistance by a licensed health care provider |
|---|
| 28 | 28 | | who is authorized to prescribe methadone, buprenorphine, or |
|---|
| 29 | 29 | | naltrexone. |
|---|
| 30 | 30 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 31 | 31 | | a state agency determines that a waiver or authorization from a |
|---|
| 32 | 32 | | federal agency is necessary for implementation of that provision, |
|---|
| 33 | 33 | | the agency affected by the provision shall request the waiver or |
|---|
| 34 | 34 | | authorization and may delay implementing that provision until the |
|---|
| 35 | 35 | | waiver or authorization is granted. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect September 1, 2019. |
