66 AN ACT
77 relating to the appointment of a board of managers to govern certain
88 school districts with low-performing campuses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39A.107, Education Code, is amended by
1111 adding Subsection (e) to read as follows:
1212 (e) Notwithstanding Subsection (c), the commissioner may
1313 not order the appointment of a board of managers to govern a school
1414 district unless at least 15 percent of the campuses in the district
1515 are assigned an unacceptable performance rating.
1616 SECTION 2. Section 39A.111, Education Code, is amended to
1717 read as follows:
1818 Sec. 39A.111. CONTINUED UNACCEPTABLE PERFORMANCE
1919 RATING. (a) If a campus is considered to have an unacceptable
2020 performance rating for three consecutive school years after the
2121 campus is ordered to submit a campus turnaround plan under Section
2222 39A.101, the commissioner, subject to Section 39A.112, shall order:
2323 (1) appointment of a board of managers to govern the
2424 school district as provided by Section 39A.202; or
2525 (2) closure of the campus.
2626 (b) Notwithstanding Subsection (a), the commissioner may
2727 not order the appointment of a board of managers to govern the
2828 school district unless at least 15 percent of the campuses in the
2929 district are assigned an unacceptable performance rating.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2019.
