| 7 | 7 | | relating to the appointment of a board of managers to govern certain |

| 8 | 8 | | school districts with low-performing campuses. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 39A.107, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (e) to read as follows: |
|---|
| 12 | 12 | | (e) Notwithstanding Subsection (c), the commissioner may |
|---|
| 13 | 13 | | not order the appointment of a board of managers to govern a school |
|---|
| 14 | 14 | | district unless at least 15 percent of the campuses in the district |
|---|
| 15 | 15 | | are assigned an unacceptable performance rating. |
|---|
| 16 | 16 | | SECTION 2. Section 39A.111, Education Code, is amended to |
|---|
| 17 | 17 | | read as follows: |
|---|
| 18 | 18 | | Sec. 39A.111. CONTINUED UNACCEPTABLE PERFORMANCE |
|---|
| 19 | 19 | | RATING. (a) If a campus is considered to have an unacceptable |
|---|
| 20 | 20 | | performance rating for three consecutive school years after the |
|---|
| 21 | 21 | | campus is ordered to submit a campus turnaround plan under Section |
|---|
| 22 | 22 | | 39A.101, the commissioner, subject to Section 39A.112, shall order: |
|---|
| 23 | 23 | | (1) appointment of a board of managers to govern the |
|---|
| 24 | 24 | | school district as provided by Section 39A.202; or |
|---|
| 25 | 25 | | (2) closure of the campus. |
|---|
| 26 | 26 | | (b) Notwithstanding Subsection (a), the commissioner may |
|---|
| 27 | 27 | | not order the appointment of a board of managers to govern the |
|---|
| 28 | 28 | | school district unless at least 15 percent of the campuses in the |
|---|
| 29 | 29 | | district are assigned an unacceptable performance rating. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2019. |
