9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 393.004(b), Health and Safety Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (b) Except as otherwise provided by this subsection, the | |
13 | 13 | [The] prioritization criteria established under Subsection (a) | |
14 | 14 | must provide that, for each grant round, the commission may not | |
15 | 15 | award a grant to an entity that does not agree to make the | |
16 | 16 | alternative fueling facility accessible and available to the public | |
17 | 17 | at times designated by the grant contract until each eligible | |
18 | 18 | entity that does agree to those terms has been awarded a grant. The | |
19 | 19 | prohibition imposed by this subsection does not apply to a facility | |
20 | 20 | that is: | |
21 | 21 | (1) owned or operated by a transit authority governed | |
22 | 22 | by Chapter 451 or 452, Transportation Code; and | |
23 | 23 | (2) located in a county that has a population of more | |
24 | 24 | than one million. | |
25 | 25 | SECTION 2. The change in law made by this Act applies only | |
26 | 26 | to a grant round that begins on or after the effective date of this | |
27 | 27 | Act. A grant round that began before the effective date of this Act | |
28 | 28 | is governed by the law in effect on the date the grant round began, | |
29 | 29 | and the former law is continued in effect for that purpose. | |
30 | 30 | SECTION 3. This Act takes effect September 1, 2019. |
