6	8		AN ACT
7	9		relating to the business leave time account for a firefighter
8	10		employee organization in certain municipalities.
9	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	12		SECTION 1. Section 142.014, Local Government Code, is
11	13		amended by adding Subsection (j) to read as follows:
12	14		(j) Donations to the business leave time account of an
13	15		employee organization by its members may be authorized in one of the
14	16		following ways:
15	17		(1) if the majority of the membership of the employee
16	18		organization has not affirmatively voted to require contributions
17	19		by the employee organization's members to its business leave time
18	20		account:
19	21		(A) a firefighter must authorize the donation in
20	22		writing on a form provided by the employee organization and
21	23		approved by the municipality; and
22	24		(B) after receiving the signed authorization on
23	25		an approved form, the municipality shall transfer donated time to
24	26		the account monthly until the municipality receives the
25	27		firefighter's written revocation of the authorization; or
26	28		(2) if the majority of the membership of the employee
27	29		organization has affirmatively voted to require contributions by
28	30		the employee organization's members to its business leave time
29	31		account:
30	32		(A) except as provided by Paragraph (C), the
31	33		municipality shall transfer donated time to the employee
32	34		organization's business leave time account from the accumulated
33	35		vacation or compensatory time of each firefighter who is a member of
34	36		the employee organization in the amount approved by vote of the
35	37		employee organization not to exceed the amount allowed under
36	38		Subsection (c);
37	39		(B) the municipality shall transfer the donated
38	40		time to the account monthly beginning with the first calendar month
39	41		that begins after the date of the employee organization vote
40	42		requiring contributions; and
41	43		(C) each year, during the period beginning on the
42	44		60th day before the anniversary of the first day of the first
43	45		calendar month in which donations were first transferred to the
44	46		business leave time account of the employee organization under
45	47		Paragraph (B) and ending on the 30th day before that anniversary, a
46	48		firefighter who is a member of the employee organization may inform
47	49		the municipality in writing on a form provided by the employee
48	50		organization and approved by the municipality that the firefighter
49	51		chooses to not donate time to the account during the 12-month period
50	52		beginning with that anniversary.
51	53		SECTION 2. This Act takes effect September 1, 2019.
