86 AN ACT
9- relating to the medical advisory board.
7+ relating to the application of the open meetings law to the medical
8+ advisory board.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11- SECTION 1. Section 12.092, Health and Safety Code, is
12- amended by amending Subsection (a) and adding Subsection (c) to
13- read as follows:
14- (a) Except as provided in Subsection (c), the [The]
15- commissioner shall appoint the medical advisory board members from:
16- (1) persons licensed to practice medicine in this
17- state, including physicians who are board certified in internal
18- medicine, psychiatry, neurology, physical medicine, or
19- ophthalmology and who are jointly recommended by the department and
20- the Texas Medical Association; and
21- (2) persons licensed to practice optometry in this
22- state who are jointly recommended by the department and the Texas
23- Optometric Association.
24- (c) The commissioner shall appoint at least one
25- representative from the following agencies to the medical advisory
26- board:
27- (1) the department; and
28- (2) the Department of Public Safety of the State of
29- Texas.
30- SECTION 2. Section 12.094(a), Health and Safety Code, is
31- amended to read as follows:
32- (a) The executive commissioner:
33- (1) shall [may] adopt rules to govern the activities
34- of the medical advisory board;
35- (2) shall annually appoint from among the members a
36- chair and a vice chair of the medical advisory board;
37- (3) shall annually review the medical advisory board's
38- rules and internal procedures;
39- (4) by rule may establish a reasonable fee to pay a
40- member of the medical advisory board for the member's professional
41- consultation services; and
42- (5) [(3)] if appropriate, may authorize reimbursement
43- for travel expenses as provided by Section 2110.004, Government
44- Code, for each meeting a member attends.
45- SECTION 3. Section 12.095, Health and Safety Code, is
46- amended by adding Subsection (b-1) to read as follows:
47- (b-1) At least one member of a panel must have medical
48- expertise relating to the medical condition of the applicant or
49- license holder whose application or license is being considered by
50- the panel.
51- SECTION 4. This Act takes effect September 1, 2019.
10+ SECTION 1. Subchapter H, Chapter 12, Health and Safety
11+ Code, is amended by adding Section 12.099 to read as follows:
12+ Sec. 12.099. OPEN MEETINGS. (a) All meetings of the
13+ medical advisory board or a panel shall be conducted in accordance
14+ with the open meetings law, Chapter 551, Government Code.
15+ (b) This section and Chapter 551, Government Code, do not
16+ require the medical advisory board or a panel to conduct an open
17+ meeting to deliberate a record, a report, or testimony described by
18+ Section 12.097(a).
19+ SECTION 2. This Act takes effect September 1, 2019.
