| 7 | 7 | | relating to municipal delegation of certain subdivision plat or |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 212.0065(a), Local Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) The governing body of a municipality may delegate to one |
|---|
| 13 | 13 | | or more officers or employees of the municipality or of a utility |
|---|
| 14 | 14 | | owned or operated by the municipality the ability to approve: |
|---|
| 15 | 15 | | (1) amending plats described by Section 212.016; |
|---|
| 16 | 16 | | (2) minor plats or replats involving [four or fewer] |
|---|
| 17 | 17 | | lots fronting on an existing street, including replats establishing |
|---|
| 18 | 18 | | or modifying the location of a public right-of-way or public access |
|---|
| 19 | 19 | | [and not requiring the creation of any new street or the extension |
|---|
| 20 | 20 | | of municipal facilities]; or |
|---|
| 21 | 21 | | (3) a replat under Section 212.0145 involving lots |
|---|
| 22 | 22 | | fronting on an existing street, including replats establishing or |
|---|
| 23 | 23 | | modifying the location of a public right-of-way or public access |
|---|
| 24 | 24 | | [that does not require the creation of any new street or the |
|---|
| 25 | 25 | | extension of municipal facilities]. |

| 26 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2019. |
