66 AN ACT
77 relating to municipal delegation of certain subdivision plat or
88 replat approval responsibility.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 212.0065(a), Local Government Code, is
1111 amended to read as follows:
1212 (a) The governing body of a municipality may delegate to one
1313 or more officers or employees of the municipality or of a utility
1414 owned or operated by the municipality the ability to approve:
1515 (1) amending plats described by Section 212.016;
1616 (2) minor plats or replats involving [four or fewer]
1717 lots fronting on an existing street, including replats establishing
1818 or modifying the location of a public right-of-way or public access
1919 [and not requiring the creation of any new street or the extension
2020 of municipal facilities]; or
2121 (3) a replat under Section 212.0145 involving lots
2222 fronting on an existing street, including replats establishing or
2323 modifying the location of a public right-of-way or public access
2424 [that does not require the creation of any new street or the
2525 extension of municipal facilities].
2626 SECTION 2. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2019.
