66 AN ACT
77 relating to the authority of the Texas Commission on Environmental
88 Quality to require water pollution abatement plans from certain
99 facilities regulated by the Railroad Commission of Texas.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 26, Water Code, is amended
1212 by adding Section 26.0462 to read as follows:
1313 Sec. 26.0462. EDWARDS AQUIFER PLANS ASSOCIATED WITH OIL,
1414 GAS, OR GEOTHERMAL RESOURCES. Notwithstanding another provision of
1515 this chapter or a provision of the Natural Resources Code, the
1616 commission may require the owner or operator of a facility used in
1717 connection with an activity that is associated with the
1818 exploration, development, or production of oil, gas, or geothermal
1919 resources and regulated by the Railroad Commission of Texas to
2020 submit to the commission a water pollution abatement plan for the
2121 facility if the facility is located in the recharge zone of the
2222 Edwards Aquifer, as defined by commission rule.
2323 SECTION 2. This Act takes effect September 1, 2019.
