9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter J, Chapter 26, Water Code, is amended | |
11 | 11 | by adding Section 26.409 to read as follows: | |
12 | 12 | Sec. 26.409. CONTINGENCY PLANNING FOR PIPELINES. (a) The | |
13 | 13 | commission by rule shall require the operator of a pipeline that is | |
14 | 14 | under the jurisdiction of the pipeline safety and regulatory | |
15 | 15 | program described by Section 81.071, Natural Resources Code, to | |
16 | 16 | submit to the commission a site-specific contingency plan that | |
17 | 17 | describes measures to be taken to control, contain, and collect any | |
18 | 18 | discharge of fluids from the pipeline to minimize impacts to | |
19 | 19 | groundwater in this state. | |
20 | 20 | (b) The commission may reject a plan submitted under | |
21 | 21 | Subsection (a), and require a new plan, if the commission | |
22 | 22 | determines that the submitted plan is insufficient to safeguard | |
23 | 23 | present and future groundwater supplies. | |
24 | 24 | (c) The commission shall send each plan accepted under this | |
25 | 25 | section to the Pipeline and Hazardous Materials Safety | |
26 | 26 | Administration or a successor agency. | |
27 | 27 | SECTION 2. This Act takes effect September 1, 2019. |
