9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 211, Local Government Code, is amended | |
11 | 11 | by adding Subchapter Z to read as follows: | |
12 | 12 | SUBCHAPTER Z. MISCELLANEOUS PROVISIONS | |
13 | 13 | Sec. 211.901. REGULATION OF PIPELINES. (a) This section | |
14 | 14 | applies only to an intrastate pipeline that transports hazardous | |
15 | 15 | liquid, as defined by Section 117.001, Natural Resources Code, | |
16 | 16 | carbon dioxide, or natural gas. | |
17 | 17 | (b) The governing body of a municipality may require a | |
18 | 18 | pipeline to be buried to a depth of not more than 12 feet. | |
19 | 19 | (c) In the case of a conflict between this section and | |
20 | 20 | Chapter 81, 111, or 117, Natural Resources Code, or Chapter 121, | |
21 | 21 | Utilities Code, this section prevails. | |
22 | 22 | SECTION 2. This Act takes effect September 1, 2019. |
