58 AN ACT
69 relating to an optional county fee on vehicle registration to be
710 used by a regional mobility authority.
811 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9- SECTION 1. Sections 502.402(a), (b-1), and (e),
10- Transportation Code, are amended to read as follows:

1114 (a) This section applies only to:
1215 (1) a county that:
1316 (A) borders the United Mexican States; and
1417 (B) has a population of more than 250,000; [and]
1518 (2) a county that has a population of more than 1.5
16- million that is coterminous with a regional mobility authority;
19+ million that is coterminous with a regional mobility authority; and
1720 (3) a county that:
1821 (A) is part of a regional mobility authority that
1922 includes at least one other county; and
20- (B) borders the United Mexican States; and
21- (4) a county:
22- (A) that has a population of more than 320,000;
23- (B) that does not border the United Mexican
24- States; and
25- (C) in which a port authority is authorized to
26- issue permits for oversize or overweight vehicles under Chapter
27- 623.
23+ (B) borders the United Mexican States.
2824 (b-1) The commissioners court of a county described by
2925 Subsection (a)(1) [(a)] with a population of less than 700,000 may
3026 increase the additional fee to an amount that does not exceed $20 if
3127 approved by a majority of the qualified voters of the county voting
3228 on the issue at a referendum election, which the commissioners
3329 court may order and hold for that purpose.
34- (e) The additional fee shall be collected for a vehicle when
35- other fees imposed under this chapter are collected. The fee
36- revenue collected shall be:
37- (1) sent to a regional mobility authority located in
38- the county to fund long-term transportation projects in the county
39- that are consistent with the purposes specified by Section 7-a,
40- Article VIII, Texas Constitution; or
41- (2) if there is no regional mobility authority located
42- in the county, used by the county only to fund long-term
43- transportation projects in the county that are consistent with the
44- purposes specified by Section 7-a, Article VIII, Texas
45- Constitution.
4630 SECTION 2. This Act takes effect immediately if it receives
4731 a vote of two-thirds of all the members elected to each house, as
4832 provided by Section 39, Article III, Texas Constitution. If this
4933 Act does not receive the vote necessary for immediate effect, this
5034 Act takes effect September 1, 2019.
