66 AN ACT
77 relating to revocation of do-not-resuscitate orders for patients
88 admitted to a health care facility or hospital.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 166.205(a), (b), and (c), Health and
1111 Safety Code, are amended to read as follows:
1212 (a) A physician providing direct care to a patient for whom
1313 a DNR order is issued shall revoke the patient's DNR order if:
1414 (1) the advance directive on which the DNR order is
1515 based is revoked in accordance with this chapter; or
1616 (2) the patient or the individual whose direction or
1717 treatment decision was the basis for issuing the DNR order[, as
1818 applicable, the patient's agent under a medical power of attorney
1919 or the patient's legal guardian if the patient is incompetent:
2020 [(1) effectively revokes an advance directive, in
2121 accordance with Section 166.042, for which a DNR order is issued
2222 under Section 166.203(a); or
2323 [(2)] expresses to any person providing direct care to
2424 the patient a revocation of consent to or intent to revoke a DNR
2525 order issued under Section 166.203(a).
2626 (b) A person providing direct care to a patient under the
2727 supervision of a physician shall notify the physician of:
2828 (1) the revocation of the advance directive described
2929 by Subsection (a)(1); or
3030 (2) the request to revoke a DNR order under Subsection
3131 (a)(2) [(a)].
3232 (c) The [A patient's attending] physician who issued [may at
3333 any time revoke] a DNR order issued under Section 166.203(a)(2) may
3434 at any time revoke the DNR order.
3535 SECTION 2. This Act takes effect September 1, 2019.
