79 relating to satisfaction of continuing education requirements for
810 certain insurance adjusters.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Subchapter B, Chapter 4101, Insurance Code, is
1113 amended by adding Section 4101.062 to read as follows:
1214 Sec. 4101.062. ALTERNATIVE CONTINUING EDUCATION: CLAIMS
1315 CERTIFICATION. Notwithstanding Section 4004.051, the department
1416 shall accept as satisfaction of any continuing education
1517 requirement imposed on an adjuster under this chapter or Chapter
1618 4004 a claims certification that the adjuster receives during a
1719 license period for which the continuing education is required if:
1820 (1) the claims certification is issued by a national
1921 or state claims association with a certification program;
2022 (2) the number of hours required to complete the
2123 certification program is not less than the number of hours of
2224 continuing education that an adjuster is required to complete
2325 during the license period under Sections 4004.053 and 4004.054;
2426 (3) the content of the certification program:
2527 (A) includes the content required under Section
2628 4004.105; and
2729 (B) is made available through an electronic
2830 portal maintained by the association for review and audit by the
2931 department;
3032 (4) the association is approved by the department as a
3133 continuing education provider;
3234 (5) the association reports the adjuster's completion
3335 of the certification program to the department through an
3436 electronic portal maintained by the department; and
3537 (6) the association, through an electronic portal
3638 maintained by the association, provides the department access to
3739 the adjuster's transcript showing the adjuster's completion of the
3840 certification program.
3941 SECTION 2. The change in law made by Section 4101.062,
4042 Insurance Code, as added by this Act, applies to continuing
4143 education requirements for an insurance adjuster's license period
4244 beginning on or after January 1, 2020.
4345 SECTION 3. This Act takes effect September 1, 2019.
