| 9 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 12 | | SECTION 1. Subchapter B, Chapter 4101, Insurance Code, is |
|---|
| 11 | 13 | | amended by adding Section 4101.062 to read as follows: |
|---|
| 12 | 14 | | Sec. 4101.062. ALTERNATIVE CONTINUING EDUCATION: CLAIMS |
|---|
| 13 | 15 | | CERTIFICATION. Notwithstanding Section 4004.051, the department |
|---|
| 14 | 16 | | shall accept as satisfaction of any continuing education |
|---|
| 15 | 17 | | requirement imposed on an adjuster under this chapter or Chapter |
|---|
| 16 | 18 | | 4004 a claims certification that the adjuster receives during a |
|---|
| 17 | 19 | | license period for which the continuing education is required if: |
|---|
| 18 | 20 | | (1) the claims certification is issued by a national |
|---|
| 19 | 21 | | or state claims association with a certification program; |
|---|
| 20 | 22 | | (2) the number of hours required to complete the |
|---|
| 21 | 23 | | certification program is not less than the number of hours of |
|---|
| 22 | 24 | | continuing education that an adjuster is required to complete |
|---|
| 23 | 25 | | during the license period under Sections 4004.053 and 4004.054; |
|---|
| 24 | 26 | | (3) the content of the certification program: |
|---|
| 25 | 27 | | (A) includes the content required under Section |
|---|
| 26 | 28 | | 4004.105; and |
|---|
| 27 | 29 | | (B) is made available through an electronic |
|---|
| 28 | 30 | | portal maintained by the association for review and audit by the |
|---|
| 29 | 31 | | department; |
|---|
| 30 | 32 | | (4) the association is approved by the department as a |
|---|
| 31 | 33 | | continuing education provider; |
|---|
| 32 | 34 | | (5) the association reports the adjuster's completion |
|---|
| 33 | 35 | | of the certification program to the department through an |
|---|
| 34 | 36 | | electronic portal maintained by the department; and |
|---|
| 35 | 37 | | (6) the association, through an electronic portal |
|---|
| 36 | 38 | | maintained by the association, provides the department access to |
|---|
| 37 | 39 | | the adjuster's transcript showing the adjuster's completion of the |
|---|
| 38 | 40 | | certification program. |
|---|
| 39 | 41 | | SECTION 2. The change in law made by Section 4101.062, |
|---|
| 40 | 42 | | Insurance Code, as added by this Act, applies to continuing |
|---|
| 41 | 43 | | education requirements for an insurance adjuster's license period |
|---|
| 42 | 44 | | beginning on or after January 1, 2020. |
|---|
| 43 | 45 | | SECTION 3. This Act takes effect September 1, 2019. |
