410 AN ACT
511 relating to the eligibility of land on which the Texas Animal Health
612 Commission has established a temporary quarantine for ticks for
713 appraisal for ad valorem tax purposes as agricultural or open-space
814 land.
915 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1016 SECTION 1. Subchapter C, Chapter 23, Tax Code, is amended by
1117 adding Section 23.426 to read as follows:
1218 Sec. 23.426. TEMPORARY CESSATION OF AGRICULTURAL USE DUE TO
1319 QUARANTINE FOR TICKS. (a) The entitlement of an individual to have
1420 land the individual owns designated for agricultural use under this
1521 subchapter does not end because the individual ceases exclusively
1622 or continuously using the land for agriculture as an occupation or a
1723 business venture for profit for the period prescribed by Subsection
1824 (b) if the land:
1925 (1) is subject to a temporary quarantine established
2026 at any time during the tax year by the Texas Animal Health
2127 Commission for the purpose of regulating the handling of livestock
2228 and eradicating ticks or exposure to ticks under Chapter 167,
2329 Agriculture Code; and
2430 (2) otherwise continues to qualify for the designation
2531 under Section 23.42.
2632 (b) Subsection (a) applies to land eligible for appraisal
2733 under this subchapter only during the period that begins on the date
2834 the land is designated as a tick eradication area and that ends on
2935 the date the land is released from quarantine by the Texas Animal
3036 Health Commission.
3137 (c) The owner of land to which this section applies must,
3238 not later than the 30th day after the date the land is designated as
3339 a tick eradication area, notify in writing the chief appraiser for
3440 each appraisal district in which the land is located that the land
3541 is located in a tick eradication area.
3642 (d) The owner of land to which this section applies must,
3743 not later than the 30th day after the date the land is released from
3844 quarantine by the Texas Animal Health Commission, notify in writing
3945 the chief appraiser for each appraisal district in which the land is
4046 located that the land has been released from quarantine by the Texas
4147 Animal Health Commission.
4248 SECTION 2. Subchapter D, Chapter 23, Tax Code, is amended by
4349 adding Section 23.526 to read as follows:
4450 Sec. 23.526. TEMPORARY CESSATION OF AGRICULTURAL USE DUE TO
4551 QUARANTINE FOR TICKS. (a) The eligibility of land for appraisal
4652 under this subchapter does not end because the land ceases to be
4753 devoted principally to agricultural use to the degree of intensity
4854 generally accepted in the area for the period prescribed by
4955 Subsection (b) if the land:
5056 (1) is subject to a temporary quarantine established
5157 at any time during the tax year by the Texas Animal Health
5258 Commission for the purpose of regulating the handling of livestock
5359 and eradicating ticks or exposure to ticks under Chapter 167,
5460 Agriculture Code;
5561 (2) is appraised under this subchapter primarily on
5662 the basis of the livestock located in the area subject to quarantine
5763 in the tax year; and
5864 (3) otherwise continues to qualify for appraisal under
5965 this subchapter.
6066 (b) Subsection (a) applies to land eligible for appraisal
6167 under this subchapter only during the period that begins on the date
6268 the land is designated as a tick eradication area and that ends on
6369 the date the land is released from quarantine by the Texas Animal
6470 Health Commission.
6571 (c) The owner of land to which this section applies must,
6672 not later than the 30th day after the date the land is designated as
6773 a tick eradication area, notify in writing the chief appraiser for
6874 each appraisal district in which the land is located that the land
6975 is located in a tick eradication area.
7076 (d) The owner of land to which this section applies must,
7177 not later than the 30th day after the date the land is released from
7278 quarantine by the Texas Animal Health Commission, notify in writing
7379 the chief appraiser for each appraisal district in which the land is
7480 located that the land has been released from quarantine by the Texas
7581 Animal Health Commission.
7682 SECTION 3. The change in law made by this Act does not
7783 affect an additional tax imposed as a result of a change of use of
7884 land appraised under Subchapter C or D, Chapter 23, Tax Code, that
7985 occurred before the effective date of this Act.
8086 SECTION 4. This Act takes effect immediately if it receives
8187 a vote of two-thirds of all the members elected to each house, as
8288 provided by Section 39, Article III, Texas Constitution. If this
8389 Act does not receive the vote necessary for immediate effect, this
8490 Act takes effect September 1, 2019.
