66 AN ACT
77 relating to accommodating a voter unable to enter a polling place.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 64.009, Election Code, is amended by
1010 adding Subsection (e) to read as follows:
1111 (e) At each polling place a parking space shall be reserved
1212 for voting under this section. The space may not be a parking space
1313 designated specifically for persons with disabilities. The parking
1414 space must be clearly marked for use by a voter who is unable to
1515 enter the polling place with a sign. The sign must have a telephone
1616 number for a voter to request assistance from election officials at
1717 the polling place.
1818 SECTION 2. Section 104.004(e), Election Code, is amended to
1919 read as follows:
2020 (e) If the voter is physically unable to enter the early
2121 voting polling place without personal assistance or a likelihood of
2222 injuring the voter's health, the clerk shall deliver the balloting
2323 materials to the voter at the polling place entrance or curb
2424 following the procedures prescribed by Section 64.009.
2525 SECTION 3. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2019.
