| 7 | 7 | | relating to authorizing an optional county fee on vehicle |

| 8 | 8 | | registration in certain counties to be used for transportation |

|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Sections 502.402(a) and (b-1), Transportation |
|---|
| 12 | 12 | | Code, are amended to read as follows: |
|---|
| 13 | 13 | | (a) This section applies only to: |
|---|
| 14 | 14 | | (1) a county that: |
|---|
| 15 | 15 | | (A) borders the United Mexican States; and |
|---|
| 16 | 16 | | (B) has a population of more than 250,000; [and] |
|---|
| 17 | 17 | | (2) a county that has a population of more than 1.5 |
|---|
| 18 | 18 | | million that is coterminous with a regional mobility authority; and |
|---|
| 19 | 19 | | (3) a county with a population of less than 500,000 |
|---|
| 20 | 20 | | that is part of a regional mobility authority created under Chapter |
|---|
| 21 | 21 | | 370 in which a county with a population of more than one million is |
|---|
| 22 | 22 | | also located. |
|---|
| 23 | 23 | | (b-1) The commissioners court of a county described by |
|---|
| 24 | 24 | | Subsection (a)(1) or (2) [(a)] with a population of less than |
|---|
| 25 | 25 | | 700,000 may increase the additional fee to an amount that does not |
|---|
| 26 | 26 | | exceed $20 if approved by a majority of the qualified voters of the |
|---|
| 27 | 27 | | county voting on the issue at a referendum election, which the |
|---|
| 28 | 28 | | commissioners court may order and hold for that purpose. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2019. |
