4	11		AN ACT
5	12		relating to the deposit and distribution by the Texas Racing
6	13		Commission of certain pari-mutuel wagering funds to benefit the
7	14		Texas-bred program.
8	15		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	16		SECTION 1. Section 2023.053, Occupations Code, is amended
10	17		by adding Subsection (f) to read as follows:
11	18		(f) This section does not apply to money deposited into the
12	19		Texas-bred incentive fund established under Section 2028.301.
13	20		SECTION 2. Section 2024.055, Occupations Code, is amended
14	21		to read as follows:
15	22		Sec. 2024.055. DEPOSIT OF STATE'S SHARE. (a) The
16	23		comptroller shall deposit the state's share of each pari-mutuel
17	24		pool from horse racing and greyhound racing in the general revenue
18	25		fund.
19	26		(b) This section does not apply to money deposited into the
20	27		Texas-bred incentive fund established under Section 2028.301.
21	28		SECTION 3. Section 2028.103, Occupations Code, is amended
22	29		by amending Subsections (a) and (c) and adding Subsection (a-1) to
23	30		read as follows:
24	31		(a) A horse racetrack association shall set aside for the
25	32		Texas-bred program and pay to the commission an amount equal to one
26	33		percent of a live multiple two wagering pool and a live multiple
27	34		three wagering pool. From the set-aside amounts:
28	35		(1) two percent shall be set aside for purposes of
29	36		Subchapter F, Chapter 88, Education Code; and
30	37		(2) the remaining amount shall be allocated as
31	38		follows:
32	39		(A) 10 percent may be used by the appropriate
33	40		state horse breed registry for administration; and
34	41		(B) the remainder shall be used for awards.
35	42		(a-1) The commission shall deposit money paid to the
36	43		commission under Subsection (a) into the Texas-bred incentive fund
37	44		established under Section 2028.301. The commission shall
38	45		distribute the money collected under this section and deposited
39	46		into the fund to the appropriate state horse breed registries for
40	47		the Texas-bred program in accordance with rules adopted under
41	48		Subsection (c).
42	49		(c) The commission shall adopt rules relating to the
43	50		deposit, accounting, auditing, and distribution of all amounts set
44	51		aside for the Texas-bred program under this subchapter and for the
45	52		use of those amounts by the state breed registries under that
46	53		program.
47	54		SECTION 4. Section 2028.105, Occupations Code, is amended
48	55		by amending Subsection (d) and adding Subsection (d-1) to read as
49	56		follows:
50	57		(d) The horse racetrack association shall pay to the
51	58		commission for deposit into the Texas-bred incentive fund
52	59		established under Section 2028.301 and distribution to the
53	60		appropriate state horse breed registry [shall pay] the remaining 80
54	61		percent of the total breakage to be allocated as follows:
55	62		(1) 40 percent to the owners of the accredited
56	63		Texas-bred horses that finish first, second, or third;
57	64		(2) 40 percent to the breeders of accredited
58	65		Texas-bred horses that finish first, second, or third; and
59	66		(3) 20 percent to the owner of the stallion standing in
60	67		this state at the time of conception whose Texas-bred get finish
61	68		first, second, or third.
62	69		(d-1) The commission shall deposit the portions of total
63	70		breakage paid to the commission under Subsections (b) and (d) into
64	71		the Texas-bred incentive fund established under Section 2028.301.
65	72		The commission shall distribute the money collected under this
66	73		section and deposited into the fund to the appropriate state horse
67	74		breed registries in accordance with this section and with rules
68	75		adopted by the commission under Section 2028.103.
69	76		SECTION 5. Section 2028.154(a), Occupations Code, is
70	77		amended to read as follows:
71	78		(a) A greyhound racetrack association shall pay 50 percent
72	79		of the breakage to the appropriate state greyhound breed registry.
73	80		Of that breakage percentage:
74	81		(1) 25 percent is to be used in stakes races; and
75	82		(2) 25 percent of that total breakage from a live
76	83		pari-mutuel pool or a simulcast pari-mutuel pool is to be paid to
77	84		the commission for deposit into the Texas-bred incentive fund
78	85		established under Section 2028.301. The commission shall
79	86		distribute the money collected under this section and deposited
80	87		into the fund to [use by] the state greyhound breed registry for use
81	88		in accordance with this section and[, subject to] commission rules.
82	89		SECTION 6. Section 2028.202, Occupations Code, is amended
83	90		by adding Subsection (a-1) to read as follows:
84	91		(a-1) A racetrack association shall pay to the commission
85	92		for deposit into the Texas-bred incentive fund established under
86	93		Section 2028.301 the shares to be distributed under Subsections
87	94		(a)(3) and (a)(4) for the Texas-bred program. The commission shall
88	95		distribute the money collected under this section and deposited
89	96		into the fund to the appropriate state breed registries for use
90	97		under the Texas-bred program.
91	98		SECTION 7. Chapter 2028, Occupations Code, is amended by
92	99		adding Subchapter G to read as follows:
93	100		SUBCHAPTER G. TEXAS-BRED INCENTIVE FUND
94	101		Sec. 2028.301. TEXAS-BRED INCENTIVE FUND. (a) The
95	102		commission shall deposit money set aside for the Texas-bred program
96	103		or set aside for use by state breed registries under this chapter
97	104		into an escrow account in the state treasury in the registry of the
98	105		commission to be known as the Texas-bred incentive fund.
99	106		(b) The commission shall distribute money from the
100	107		Texas-bred incentive fund in accordance with this chapter and
101	108		commission rules.
102	109		SECTION 8. (a) The changes in law made by this Act apply to
103	110		the deductions and breakage from a wagering pool for a horse or
104	111		greyhound race conducted by a racetrack association on or after the
105	112		effective date of this Act.
106	113		(b) As soon as practicable after the effective date of this
107	114		Act, the Texas Racing Commission shall revise existing rules or
108	115		adopt new rules as necessary to comply with this Act.
109	116		SECTION 9. This Act takes effect September 1, 2019.
