7 | 7 | | relating to the creation of a business advisory council on disaster |

8 | 8 | | recovery and mitigation. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter C, Chapter 31, Natural Resources |
---|
11 | 11 | | Code, is amended by adding Section 31.069 to read as follows: |
---|
12 | 12 | | Sec. 31.069. BUSINESS ADVISORY COUNCIL ON DISASTER RECOVERY |
---|
13 | 13 | | AND MITIGATION. (a) In this section: |
---|
14 | 14 | | (1) "Advisory council" means the business advisory |
---|
15 | 15 | | council on disaster recovery and mitigation established under this |
---|
16 | 16 | | section. |
---|
17 | 17 | | (2) "Disaster" has the meaning assigned by Section |
---|
18 | 18 | | 418.004, Government Code. |
---|
19 | 19 | | (b) The business advisory council on disaster recovery and |
---|
20 | 20 | | mitigation is established to provide to the commissioner advice and |
---|
21 | 21 | | expertise on disaster recovery and mitigation as described by |
---|
22 | 22 | | Subsection (g). |
---|
23 | 23 | | (c) The advisory council is composed of six representatives |
---|
24 | 24 | | appointed by the commissioner as follows: |
---|
25 | 25 | | (1) one member representing banking and insurance |
---|
26 | 26 | | entities in this state that provide mortgage lending and insurance |
---|
27 | 27 | | for homeowners and businesses; |
---|
28 | 28 | | (2) one member representing construction entities in |
---|
29 | 29 | | this state engaged in the construction of commercial, industrial, |
---|
30 | 30 | | and residential buildings; |
---|
31 | 31 | | (3) one member representing the manufacturers in this |
---|
32 | 32 | | state that produce construction materials; |
---|
33 | 33 | | (4) one member representing the oil and gas refiners |
---|
34 | 34 | | and processing industries having major industrial infrastructure |
---|
35 | 35 | | in areas of this state adjacent to the Gulf of Mexico that are most |
---|
36 | 36 | | vulnerable to damage from hurricanes and flooding; |
---|
37 | 37 | | (5) one member representing the tourist and |
---|
38 | 38 | | hospitality industry in areas of this state adjacent to the Gulf of |
---|
39 | 39 | | Mexico that are most vulnerable to damage from hurricanes and |
---|
40 | 40 | | flooding; and |
---|
41 | 41 | | (6) one member representing small businesses in this |
---|
42 | 42 | | state that would be affected following a disaster by loss of |
---|
43 | 43 | | customers, lost employees, and limited insurance. |
---|
44 | 44 | | (d) Members of the advisory council serve staggered |
---|
45 | 45 | | four-year terms. |
---|
46 | 46 | | (e) An advisory council member is not entitled to |
---|
47 | 47 | | compensation but is entitled to reimbursement for travel expenses |
---|
48 | 48 | | incurred by the member while conducting the business of the |
---|
49 | 49 | | advisory council. |
---|
50 | 50 | | (f) The advisory council members shall elect a presiding |
---|
51 | 51 | | officer from among the members. |
---|
52 | 52 | | (g) The advisory council shall: |
---|
53 | 53 | | (1) provide advice on disaster recovery mitigation and |
---|
54 | 54 | | resilience, specifically related to housing; |
---|
55 | 55 | | (2) provide information on advanced technological |
---|
56 | 56 | | systems for disaster construction engineering and other innovative |
---|
57 | 57 | | solutions for addressing infrastructure risks; |
---|
58 | 58 | | (3) provide information on banking and insurance |
---|
59 | 59 | | requirements imposed following a disaster that may affect housing |
---|
60 | 60 | | construction and recovery in areas affected by the disaster; |
---|
61 | 61 | | (4) provide advice during disaster recovery on issues |
---|
62 | 62 | | faced by state and local governments; and |
---|
63 | 63 | | (5) propose solutions to address inefficiencies or |
---|
64 | 64 | | problems in the state or local governmental disaster response with |
---|
65 | 65 | | respect to issues described by this subsection. |
---|
66 | 66 | | (h) The advisory council shall meet at the times and |
---|
67 | 67 | | locations determined by the presiding officer, not to exceed four |
---|
68 | 68 | | meetings each year. |
---|
69 | 69 | | (i) Not later than November 1 of each even-numbered year, |
---|
70 | 70 | | the advisory council shall submit a report on the advisory |
---|
71 | 71 | | council's activities, advice, and proposed solutions to the |
---|
72 | 72 | | commissioner, the Texas Division of Emergency Management, the |
---|
73 | 73 | | governor, the lieutenant governor, and the speaker of the house of |
---|
74 | 74 | | representatives. |
---|
75 | 75 | | (j) The land office shall provide administrative support to |
---|
76 | 76 | | the advisory council. |
---|
77 | 77 | | (k) Chapter 2110, Government Code, does not apply to the |
---|
78 | 78 | | advisory council. |
---|
79 | 79 | | SECTION 2. As soon as practicable after the effective date |
---|
80 | 80 | | of this Act, the commissioner of the General Land Office shall |
---|
81 | 81 | | appoint to the business advisory council on disaster recovery and |
---|
82 | 82 | | mitigation two members to terms expiring February 1, 2021, two |
---|
83 | 83 | | members to terms expiring February 1, 2022, and two members to |
---|
84 | 84 | | terms expiring February 1, 2023. |
---|
85 | 85 | | SECTION 3. This Act takes effect September 1, 2019. |
