44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to outdoor advertising signs regulated by the Texas
77 Department of Transportation.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 391.038, Transportation Code, is amended
1010 by amending Subsection (b) and adding Subsection (d) to read as
1111 follows:
1212 (b) A sign [described by Subsection (a)] may not be higher
1313 than 42-1/2 [85] feet, excluding a cutout that extends above the
1414 rectangular border of the sign, measured:
1515 (1) from the grade level of the centerline of the
1616 main-traveled way, not including a frontage road of a controlled
1717 access highway, closest to the sign at a point perpendicular to the
1818 sign location; or
1919 (2) if the main-traveled way is below grade, from the
2020 base of the sign structure.
2121 (d) Subsection (b) does not apply to a sign that:
2222 (1) was higher than 42-1/2 feet on March 1, 2017; and
2323 (2) under an agreement with the department, is
2424 authorized to be higher than 42-1/2 feet.
2525 SECTION 2. Sections 391.038(a) and (c), Transportation
2626 Code, are repealed.
2727 SECTION 3. The changes in law made by this Act apply to a
2828 sign existing before, on, or after the effective date of this Act.
2929 SECTION 4. This Act takes effect September 1, 2019.
