| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 28.002, Education Code, is amended by | |
| 11 | 11 | adding Subsection (l-4) to read as follows: | |
| 12 | 12 | (l-4) A school district shall require a student enrolled in | |
| 13 | 13 | full-day prekindergarten, in kindergarten, or in a grade level | |
| 14 | 14 | below grade three to participate in an unstructured daily recess | |
| 15 | 15 | period of at least 30 minutes. The recess period required by this | |
| 16 | 16 | subsection is in addition to any period of moderate or vigorous | |
| 17 | 17 | physical activity required under Subsection (l). | |
| 18 | 18 | SECTION 2. This Act applies beginning with the 2019-2020 | |
| 19 | 19 | school year. | |
| 20 | 20 | SECTION 3. This Act takes effect immediately if it receives | |
| 21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
| 22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
| 23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
| 24 | 24 | Act takes effect September 1, 2019. |
