| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 31, Natural Resources |
|---|
| 12 | 12 | | Code, is amended by adding Section 31.069 to read as follows: |
|---|
| 13 | 13 | | Sec. 31.069. INDEFINITE QUANTITY CONTRACTS FOR SERVICES |
|---|
| 14 | 14 | | AFTER DECLARED NATURAL DISASTER. (a) Not later than May 1 of each |
|---|
| 15 | 15 | | year, the land office shall enter into indefinite quantity |
|---|
| 16 | 16 | | contracts with vendors to provide information management services, |
|---|
| 17 | 17 | | construction services, including engineering construction |
|---|
| 18 | 18 | | services, and other services the land office determines may be |
|---|
| 19 | 19 | | necessary to construct, repair, or rebuild property or |
|---|
| 20 | 20 | | infrastructure in the event of a natural disaster. |
|---|
| 21 | 21 | | (b) The terms of a contract under Subsection (a) must |
|---|
| 22 | 22 | | provide that the contract is contingent on: |
|---|
| 23 | 23 | | (1) the availability of funds; |
|---|
| 24 | 24 | | (2) the occurrence of a natural disaster not later |
|---|
| 25 | 25 | | than 12 months after the effective date of the contract; and |
|---|
| 26 | 26 | | (3) delivery of the services to an area of this state |
|---|
| 27 | 27 | | declared by the governor or president of the United States under law |
|---|
| 28 | 28 | | to be a disaster area as a result of the natural disaster. |
|---|
| 29 | 29 | | (c) If the land office determines that federal funds may be |
|---|
| 30 | 30 | | used for a contract under Subsection (a), the land office shall |
|---|
| 31 | 31 | | ensure that the contract complies with the requirements of the |
|---|
| 32 | 32 | | Federal Acquisition Regulation (48 C.F.R. Chapter 1), or a |
|---|
| 33 | 33 | | successor regulation. |
|---|
| 34 | 34 | | (d) In awarding a contract under this section, the land |
|---|
| 35 | 35 | | office shall consider and apply any applicable state law and rules |
|---|
| 36 | 36 | | of the land office relating to contracting with historically |
|---|
| 37 | 37 | | underutilized businesses. |
|---|
| 38 | 38 | | SECTION 2. This Act takes effect September 1, 2019. |
