66 AN ACT
77 relating to indefinite quantity contracts for the provision of
88 certain services to declared disaster areas following a natural
99 disaster.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 31, Natural Resources
1212 Code, is amended by adding Section 31.069 to read as follows:
1313 Sec. 31.069. INDEFINITE QUANTITY CONTRACTS FOR SERVICES
1414 AFTER DECLARED NATURAL DISASTER. (a) Not later than May 1 of each
1515 year, the land office shall enter into indefinite quantity
1616 contracts with vendors to provide information management services,
1717 construction services, including engineering construction
1818 services, and other services the land office determines may be
1919 necessary to construct, repair, or rebuild property or
2020 infrastructure in the event of a natural disaster.
2121 (b) The terms of a contract under Subsection (a) must
2222 provide that the contract is contingent on:
2323 (1) the availability of funds;
2424 (2) the occurrence of a natural disaster not later
2525 than 12 months after the effective date of the contract; and
2626 (3) delivery of the services to an area of this state
2727 declared by the governor or president of the United States under law
2828 to be a disaster area as a result of the natural disaster.
2929 (c) If the land office determines that federal funds may be
3030 used for a contract under Subsection (a), the land office shall
3131 ensure that the contract complies with the requirements of the
3232 Federal Acquisition Regulation (48 C.F.R. Chapter 1), or a
3333 successor regulation.
3434 (d) In awarding a contract under this section, the land
3535 office shall consider and apply any applicable state law and rules
3636 of the land office relating to contracting with historically
3737 underutilized businesses.
3838 SECTION 2. This Act takes effect September 1, 2019.
