8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Chapter 22, Alcoholic Beverage Code, is amended | |
10 | 10 | by adding Section 22.18 to read as follows: | |
11 | 11 | Sec. 22.18. DISTANCE FROM OTHER PACKAGE STORES. Except as | |
12 | 12 | provided by Section 109.59, on or after September 1, 2019, the | |
13 | 13 | commission may not issue a permit under this chapter for a premises | |
14 | 14 | that is located within 5000 feet of the premises of another package | |
15 | 15 | store permittee. | |
16 | 16 | SECTION 2. Section 109.59(a), Alcoholic Beverage Code, is | |
17 | 17 | amended to read as follows: | |
18 | 18 | (a) If at the time an original alcoholic beverage permit or | |
19 | 19 | license is granted for a premises the premises satisfies the | |
20 | 20 | requirements regarding distance from schools, churches, and other | |
21 | 21 | types of premises established in this code, including Section | |
22 | 22 | 22.18, | |
23 | 23 | and any other law or ordinance of the state or a political | |
24 | 24 | subdivision of the state in effect at that time, the premises shall | |
25 | 25 | be deemed to satisfy the distance requirements for all subsequent | |
26 | 26 | renewals of the license or permit. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2019. |
