55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the application of whistleblower protection laws to
88 certain appointed municipal officers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 554.001(4), Government Code, is amended
1111 to read as follows:
1212 (4) "Public employee" means:
1313 (A) an employee or appointed officer other than
1414 an independent contractor who is paid to perform services for a
1515 state or local governmental entity; or
1616 (B) an appointed officer who is an independent
1717 contractor paid to perform services for a general-law municipality.
1818 SECTION 2. The change in law made by this Act applies only
1919 to a report by a public employee of a violation of law that is made
2020 on or after the effective date of this Act. A report by a public
2121 employee of a violation of law made before the effective date of
2222 this Act is governed by the law in effect when that report is made,
2323 and the former law is continued in effect for that purpose.
2424 SECTION 3. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2019.
