86 AN ACT
97 relating to evaluating the performance of dropout recovery schools
108 for purposes of the public school accountability system.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Section 39.0548, Education Code, is amended by
1311 amending Subsections (a) and (d) and adding Subsections (a-1), (e),
14- and (f) to read as follows:
12+ (f), (g), and (h) to read as follows:
1513 (a) For purposes of evaluating performance under Section
1614 39.053(c), the commissioner shall designate as a dropout recovery
1715 school a school district or an open-enrollment charter school or a
1816 campus of a district or of an open-enrollment charter school:
1917 (1) that serves students in grades 9 through 12 and has
2018 an enrollment of which at least 50 percent of the students are 17
2119 years of age or older as of September 1 of the school year as
2220 reported for the fall semester Public Education Information
2321 Management System (PEIMS) submission; and
2422 (2) that [meets the eligibility requirements for and]
2523 is registered under alternative education accountability
2624 procedures adopted by the commissioner.
2725 (a-1) For purposes of assigning performance ratings under
2826 Section 39.054, the commissioner shall evaluate a dropout recovery
2927 school under alternative education accountability procedures
3028 adopted by the commissioner.
3129 (d) For [Notwithstanding Section 39.053(c), for] purposes
3230 of evaluating a dropout recovery school under the alternative
3331 education accountability procedures adopted by the commissioner
3432 [to determine the performance rating of the school under Section
3533 39.054], only the best result from the primary administration or
3634 any retake of an assessment instrument administered to a student in
3735 the school year evaluated may be considered in assigning
3836 performance ratings for the school under Section 39.054.
3937 (e) For purposes of evaluating performance of a dropout
40- recovery school under the alternative education accountability
41- procedures adopted by the commissioner, the commissioner shall
42- adopt performance targets for the student achievement domain under
43- Section 39.053(c)(1) and the school progress domain under Section
44- 39.053(c)(2) that are based on the average performance of school
45- districts and campuses registered under the alternative education
46- accountability procedures for the preceding school year for those
47- respective domains.
48- (f) For purposes of assigning an overall performance rating
38+ recovery school under the student achievement domain under Section
39+ 39.053(c)(1), the commissioner may consider for purposes of
40+ assigning a domain performance rating under Section 39.054 student
41+ performance based only on the "approaches grade level" performance
42+ standard. Any evaluation of student performance based on a higher
43+ performance standard may not be considered to negatively affect the
44+ domain performance rating or a performance target score of the
45+ school.
46+ (f) For purposes of evaluating performance of a dropout
47+ recovery school under the school progress domain under Section
48+ 39.053(c)(2), the commissioner may award credit for academic growth
49+ for purposes of assigning a domain performance rating under Section
50+ 39.054 based only on a student reaching the "approaches grade
51+ level" performance standard. Any evaluation of student performance
52+ based on reaching a higher academic growth performance standard may
53+ not be considered to negatively affect the amount of credit awarded
54+ to the school or the domain performance rating or a performance
55+ target score of the school.
56+ (g) For purposes of assigning an overall performance rating
4957 for a dropout recovery school under Section 39.054, the
50- commissioner shall attribute not more than 10 percent of that
51- rating to the closing the gaps domain under Section 39.053(c)(3).
52- SECTION 2. (a) This Act takes effect on any date not later
53- than September 1, 2021, on which the commissioner of education:
54- (1) obtains any necessary waiver from the application
55- of federal law or regulation conflicting with Section 39.0548,
56- Education Code, as amended by this Act; or
57- (2) receives written notification from the United
58- States Department of Education that a waiver is not required.
59- (b) This Act applies beginning with the first school year
60- that begins after the date on which this Act takes effect under
61- Subsection (a) of this section.
62- (c) If the commissioner of education obtains any necessary
63- waiver or receives written notification as described by Subsection
64- (a) of this section, the commissioner shall certify that the
65- commissioner has obtained the waiver or received notification that
66- a waiver is not required, as applicable, and shall publish notice of
67- that fact in the Texas Register as soon as practicable after
68- obtaining the waiver or receiving notification.
58+ commissioner shall consider only the school's domain performance
59+ ratings under the student achievement domain under Section
60+ 39.053(c)(1) and the school progress domain under Section
61+ 39.053(c)(2).
62+ (h) The performance of a dropout recovery school under the
63+ closing the gaps domain under Section 39.053(c)(3) may be used for
64+ reporting purposes only.
65+ SECTION 2. This Act applies beginning with the 2019-2020
66+ school year.
67+ SECTION 3. This Act takes effect immediately if it receives
68+ a vote of two-thirds of all the members elected to each house, as
69+ provided by Section 39, Article III, Texas Constitution. If this
70+ Act does not receive the vote necessary for immediate effect, this
71+ Act takes effect September 1, 2019.
