55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the membership of a public school concussion oversight
88 team and the removal of a public school student from an
99 interscholastic athletic activity on the basis of a suspected
1010 concussion.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 38.154, Education Code, is amended by
1313 adding Subsection (a-1) to read as follows:
1414 (a-1) A school district or open-enrollment charter school
1515 may include any medical professional who is licensed in this state
1616 as a member of the district or charter school concussion oversight
1717 team, provided that the professional meets the training requirement
1818 under Subsection (c).
1919 SECTION 2. Section 38.156, Education Code, is amended to
2020 read as follows:
2121 Sec. 38.156. REMOVAL FROM PLAY IN PRACTICE OR COMPETITION
2222 FOLLOWING CONCUSSION. A student shall be removed from an
2323 interscholastic athletics practice or competition immediately if
2424 one of the following persons believes the student might have
2525 sustained a concussion during the practice or competition:
2626 (1) a coach;
2727 (2) a physician;
2828 (3) a licensed health care professional;
2929 (4) a person licensed under Chapter 201 or 453,
3030 Occupations Code; or
3131 (5) the student's parent or guardian or another person
3232 with legal authority to make medical decisions for the student.
3333 SECTION 3. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2019.
