55 AN ACT
66 Relating to allowing TJJD to approve a small number of Regional
77 Diversion Alternatives placements for youth with intense needs at a
88 higher rate than the average daily cost of state secure facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sec. 223.001(d), Human Resources Code, is
1111 amended to read as follows:
1212 (d) The department shall reimburse counties for the
1313 placement of children in the regional specialized program at a rate
1414 that offers a savings to the state in relation to the average cost
1515 per day for confining a child in a department facility operated
1616 under Subtitle C.
1717 (d-1) Under the regionalization program, TJJD may determine
1818 the cost savings to the state by calculating the average cost of all
1919 diversion placements in each fiscal year of the biennium in
2020 comparison to the state secure facilities average daily cost.
2121 (e) The department may not adversely impact the state aid
2222 for a juvenile board or a juvenile probation department that does
2323 not enter into a contract to serve youth from other counties, or
2424 does not act as a regional facility.
2525 (f) A juvenile board or juvenile probation department may
2626 not be required to accept a child for placement in a
2727 post-adjudication correctional facility, unless the child is
2828 subject to an order issued by a juvenile court served by that board
2929 or department.
