9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Sec. 223.001(d), Human Resources Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (d) The department shall reimburse counties for the | |
13 | 13 | placement of children in the regional specialized program at a rate | |
14 | 14 | that offers a savings to the state in relation to the average cost | |
15 | 15 | per day for confining a child in a department facility operated | |
16 | 16 | under Subtitle C. | |
17 | 17 | (d-1) Under the regionalization program, TJJD may determine | |
18 | 18 | the cost savings to the state by calculating the average cost of all | |
19 | 19 | diversion placements in each fiscal year of the biennium in | |
20 | 20 | comparison to the state secure facilities average daily cost. | |
21 | 21 | (e) The department may not adversely impact the state aid | |
22 | 22 | for a juvenile board or a juvenile probation department that does | |
23 | 23 | not enter into a contract to serve youth from other counties, or | |
24 | 24 | does not act as a regional facility. | |
25 | 25 | (f) A juvenile board or juvenile probation department may | |
26 | 26 | not be required to accept a child for placement in a | |
27 | 27 | post-adjudication correctional facility, unless the child is | |
28 | 28 | subject to an order issued by a juvenile court served by that board | |
29 | 29 | or department. |
