| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 11, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 11.184 to read as follows: |
|---|
| 12 | 12 | | Sec. 11.184. EFFICIENCY AUDIT. (a) For purposes of this |
|---|
| 13 | 13 | | section, "efficiency audit" means an investigation of the |
|---|
| 14 | 14 | | operations of an independent school district to examine fiscal |
|---|
| 15 | 15 | | management and efficiency. |
|---|
| 16 | 16 | | (b) The board of trustees of an independent school district |
|---|
| 17 | 17 | | shall conduct an efficiency audit if: |
|---|
| 18 | 18 | | (1) a petition requesting the board to conduct an |
|---|
| 19 | 19 | | efficiency audit for the district is: |
|---|
| 20 | 20 | | (A) signed not more than 90 days before the date |
|---|
| 21 | 21 | | of submission by at least 10 percent of the voters who voted in the |
|---|
| 22 | 22 | | most recent election of the board of trustees of the school |
|---|
| 23 | 23 | | district; and |
|---|
| 24 | 24 | | (B) submitted to and verified by the board of |
|---|
| 25 | 25 | | trustees of the school district; and |
|---|
| 26 | 26 | | (2) a majority of the voters voting in the election |
|---|
| 27 | 27 | | under Subsection (c) approve the conducting of the efficiency |
|---|
| 28 | 28 | | audit. |
|---|
| 29 | 29 | | (c) If the board of trustees of an independent school |
|---|
| 30 | 30 | | district determines the petition satisfies the requirements of |
|---|
| 31 | 31 | | Subsection (b)(1)(A) and determines not to conduct an efficiency |
|---|
| 32 | 32 | | audit, the board of trustees shall order an election to be held in |
|---|
| 33 | 33 | | the district on the first uniform election date that allows |
|---|
| 34 | 34 | | sufficient time to comply with other requirements of law. |
|---|
| 35 | 35 | | (d) The ballot in an election to authorize an efficiency |
|---|
| 36 | 36 | | audit under this section shall be printed to permit voting for or |
|---|
| 37 | 37 | | against the proposition: "Requiring _________ Independent School |
|---|
| 38 | 38 | | District to conduct an efficiency audit." |
|---|
| 39 | 39 | | (e) An independent school district shall pay for an |
|---|
| 40 | 40 | | efficiency audit under this section. |
|---|
| 41 | 41 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2019. |
