8 | 8 | | fund-raiser for a nonprofit entity. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter D, Chapter 109, Alcoholic Beverage |
---|
11 | 11 | | Code, is amended by adding Section 109.581 to read as follows: |

12 | 12 | | Sec. 109.581. DONATING ALCOHOL FOR CHARITABLE EVENT. (a) A |
---|
13 | 13 | | manufacturer or wholesaler of alcoholic beverages may donate |
---|
14 | 14 | | alcoholic beverages to a nonprofit entity for a charitable |
---|
15 | 15 | | fund-raising event for the entity held on the premises of a |
---|
16 | 16 | | permitted or licensed retailer who is hosting the event. |
---|
17 | 17 | | (b) The retailer hosting the charitable event for the |
---|
18 | 18 | | nonprofit entity may not charge a fee for the alcoholic beverages at |
---|
19 | 19 | | the event but the nonprofit entity may charge a fee to attend the |
---|
20 | 20 | | event. |
---|
21 | 21 | | (c) Alcoholic beverages donated by a manufacturer or |
---|
22 | 22 | | wholesaler under this section must be delivered to the nonprofit |
---|
23 | 23 | | entity or the nonprofit entity may pick up the alcoholic beverages |
---|
24 | 24 | | and transport them to the retailer's permitted or licensed |
---|
25 | 25 | | premises. The nonprofit entity shall remove any remaining |
---|
26 | 26 | | alcoholic beverages from the retailer's premises immediately after |
---|
27 | 27 | | the charitable event. |
---|
28 | 28 | | (d) The nonprofit entity receiving alcoholic beverages from |
---|
29 | 29 | | a manufacturer or wholesaler shall provide the following |
---|
30 | 30 | | information to the commission on a form adopted by the commission: |
---|
31 | 31 | | (1) the name of the nonprofit entity; |
---|
32 | 32 | | (2) the date of the charitable event; |
---|
33 | 33 | | (3) the location of the charitable event; |
---|
34 | 34 | | (4) the dollar value of the donated alcoholic |
---|
35 | 35 | | beverages; |
---|
36 | 36 | | (5) an itemized list of the alcoholic beverages |
---|
37 | 37 | | donated; and |
---|
38 | 38 | | (6) the name of the manufacturer or wholesaler making |
---|
39 | 39 | | the donation. |
---|
40 | 40 | | (e) A manufacturer or wholesaler of alcoholic beverages may |
---|
41 | 41 | | not donate more than $5,000 worth of alcoholic beverages to a |
---|
42 | 42 | | nonprofit entity for each charitable event. |
---|
43 | 43 | | (f) A permitted or licensed retailer may not host more than |
---|
44 | 44 | | 12 charitable events under this section in a calendar year. |
---|
45 | 45 | | SECTION 2. This Act takes effect September 1, 2019. |
