66 AN ACT
77 relating to the donation of alcoholic beverages for use in a
88 fund-raiser for a nonprofit entity.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 109, Alcoholic Beverage
1111 Code, is amended by adding Section 109.581 to read as follows:
1212 Sec. 109.581. DONATING ALCOHOL FOR CHARITABLE EVENT. (a) A
1313 manufacturer or wholesaler of alcoholic beverages may donate
1414 alcoholic beverages to a nonprofit entity for a charitable
1515 fund-raising event for the entity held on the premises of a
1616 permitted or licensed retailer who is hosting the event.
1717 (b) The retailer hosting the charitable event for the
1818 nonprofit entity may not charge a fee for the alcoholic beverages at
1919 the event but the nonprofit entity may charge a fee to attend the
2020 event.
2121 (c) Alcoholic beverages donated by a manufacturer or
2222 wholesaler under this section must be delivered to the nonprofit
2323 entity or the nonprofit entity may pick up the alcoholic beverages
2424 and transport them to the retailer's permitted or licensed
2525 premises. The nonprofit entity shall remove any remaining
2626 alcoholic beverages from the retailer's premises immediately after
2727 the charitable event.
2828 (d) The nonprofit entity receiving alcoholic beverages from
2929 a manufacturer or wholesaler shall provide the following
3030 information to the commission on a form adopted by the commission:
3131 (1) the name of the nonprofit entity;
3232 (2) the date of the charitable event;
3333 (3) the location of the charitable event;
3434 (4) the dollar value of the donated alcoholic
3535 beverages;
3636 (5) an itemized list of the alcoholic beverages
3737 donated; and
3838 (6) the name of the manufacturer or wholesaler making
3939 the donation.
4040 (e) A manufacturer or wholesaler of alcoholic beverages may
4141 not donate more than $5,000 worth of alcoholic beverages to a
4242 nonprofit entity for each charitable event.
4343 (f) A permitted or licensed retailer may not host more than
4444 12 charitable events under this section in a calendar year.
4545 SECTION 2. This Act takes effect September 1, 2019.
