9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 437.003, Health and Safety Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | Sec. 437.003. COUNTY AUTHORITY TO REQUIRE PERMIT. To | |
13 | 13 | enforce state law and rules adopted under state law, the | |
14 | 14 | commissioners court of a county by order may require food service | |
15 | 15 | establishments, retail food stores, mobile food units, and roadside | |
16 | 16 | food vendors to obtain a permit from the county if the food service | |
17 | 17 | establishment, retail food store, mobile food unit, or roadside | |
18 | 18 | food vendor is located: | |
19 | 19 | (1) in an unincorporated area [areas] of the county, | |
20 | 20 | including an area [areas] in the extraterritorial jurisdiction of a | |
21 | 21 | municipality; or | |
22 | 22 | (2) on property or in a facility owned, operated, or | |
23 | 23 | leased by [, to obtain a permit from] the county. | |
24 | 24 | SECTION 2. This Act takes effect September 1, 2019. |
