4	10		AN ACT
5	11		relating to assignment of certain death benefits payable by the
6	12		Employees Retirement System of Texas.
7	13		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	14		SECTION 1. Subchapter E, Chapter 814, Government Code, is
9	15		amended by adding Section 814.404 to read as follows:
10	16		Sec. 814.404. ASSIGNMENT OF DEATH BENEFIT FOR FUNERAL
11	17		SERVICES. (a) A beneficiary to whom a benefit is payable under
12	18		this subchapter may by assignment provide that part or all of the
13	19		benefit be paid in consideration for services provided in
14	20		connection with the death of the member directly to a funeral
15	21		director or funeral establishment licensed under:
16	22		(1) Chapter 651, Occupations Code; or
17	23		(2) the comparable law of another state.
18	24		(b) The board of trustees by rule may establish requirements
19	25		for forms, documentation, and procedures necessary for an effective
20	26		assignment under this section.
21	27		SECTION 2. Subchapter F, Chapter 814, Government Code, is
22	28		amended by adding Section 814.504 to read as follows:
23	29		Sec. 814.504. ASSIGNMENT OF DEATH BENEFIT FOR FUNERAL
24	30		SERVICES. (a) A beneficiary to whom a benefit is payable under
25	31		this subchapter may by assignment provide that part or all of the
26	32		benefit be paid in consideration for services provided in
27	33		connection with the death of the retiree directly to a funeral
28	34		director or funeral establishment licensed under:
29	35		(1) Chapter 651, Occupations Code; or
30	36		(2) the comparable law of another state.
31	37		(b) The board of trustees by rule may establish requirements
32	38		for forms, documentation, and procedures necessary for an effective
33	39		assignment under this section.
34	40		SECTION 3. (a) As soon as practicable after the effective
35	41		date of this Act, but not later than January 1, 2020, the board of
36	42		trustees of the Employees Retirement System of Texas shall adopt
37	43		rules to implement Sections 814.404 and 814.504, Government Code,
38	44		as added by this Act.
39	45		(b) The change in law made by this Act by the enactment of
40	46		Sections 814.404 and 814.504, Government Code, applies only to a
41	47		benefit that is payable on or after January 1, 2020. A benefit that
42	48		is payable before that date is governed by the law in effect
43	49		immediately before January 1, 2020, and the former law is continued
44	50		in effect for that purpose.
45	51		SECTION 4. (a) Except as provided by Subsection (b) of
46	52		this section, this Act takes effect September 1, 2019.
47	53		(b) Sections 814.404 and 814.504, Government Code, as added
48	54		by this Act, take effect January 1, 2020.
