| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter A, Chapter 241, Health and Safety |
|---|
| 10 | 10 | | Code, is amended by adding Section 241.013 to read as follows: |

| 11 | 11 | | Sec. 241.013. HOSPITAL CASE MANAGERS. (a) In this section, |
|---|
| 12 | 12 | | "hospital case manager" means a person who provides health care |
|---|
| 13 | 13 | | coordination, utilization review, discharge planning, and other |
|---|
| 14 | 14 | | services to meet the health care needs of a patient in a hospital. |
|---|
| 15 | 15 | | (b) The executive commissioner by rule shall establish |
|---|
| 16 | 16 | | educational requirements for hospital case managers who are |
|---|
| 17 | 17 | | employed by or are providing services to a hospital. The rules at a |
|---|
| 18 | 18 | | minimum must require a hospital case manager to: |
|---|
| 19 | 19 | | (1) hold a license issued under Chapter 301, |
|---|
| 20 | 20 | | Occupations Code; or |
|---|
| 21 | 21 | | (2) have a master's degree from an accredited |
|---|
| 22 | 22 | | institution of higher education. |
|---|
| 23 | 23 | | (c) The commission shall ensure compliance with the |
|---|
| 24 | 24 | | requirements established under Subsection (b). |
|---|
| 25 | 25 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 26 | 26 | | of this Act, the Health and Human Services Commission shall adopt |
|---|
| 27 | 27 | | the rules necessary to implement Section 241.013, Health and Safety |
|---|
| 28 | 28 | | Code, as added by this Act. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2019. |
