55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to law enforcement access to cell site information stored
88 by certain entities providing wireless service to a wireless
99 communications device.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 18.02(a), Code of Criminal Procedure, is
1212 amended to read as follows:
1313 (a) A search warrant may be issued to search for and seize:
1414 (1) property acquired by theft or in any other manner
1515 which makes its acquisition a penal offense;
1616 (2) property specially designed, made, or adapted for
1717 or commonly used in the commission of an offense;
1818 (3) arms and munitions kept or prepared for the
1919 purposes of insurrection or riot;
2020 (4) weapons prohibited by the Penal Code;
2121 (5) gambling devices or equipment, altered gambling
2222 equipment, or gambling paraphernalia;
2323 (6) obscene materials kept or prepared for commercial
2424 distribution or exhibition, subject to the additional rules set
2525 forth by law;
2626 (7) a drug, controlled substance, immediate
2727 precursor, chemical precursor, or other controlled substance
2828 property, including an apparatus or paraphernalia kept, prepared,
2929 or manufactured in violation of the laws of this state;
3030 (8) any property the possession of which is prohibited
3131 by law;
3232 (9) implements or instruments used in the commission
3333 of a crime;
3434 (10) property or items, except the personal writings
3535 by the accused, constituting evidence of an offense or constituting
3636 evidence tending to show that a particular person committed an
3737 offense;
3838 (11) persons;
3939 (12) contraband subject to forfeiture under Chapter 59
4040 of this code;
4141 (13) electronic customer data held in electronic
4242 storage, including:
4343 (A) the contents of and records and other
4444 information related to a wire communication or electronic
4545 communication held in electronic storage; and
4646 (B) cell site information; or
4747 (14) a cellular telephone or other wireless
4848 communications device, subject to Article 18.0215.
4949 SECTION 2. Article 18.02(b)(2), Code of Criminal Procedure,
5050 as effective January 1, 2019, is amended to read as follows:
5151 (2) "Cell site information," "electronic
5252 ["Electronic] customer data," [data"] and "electronic storage"
5353 have the meanings assigned by Article 18B.001.
5454 SECTION 3. Article 18B.001, Code of Criminal Procedure, is
5555 amended by adding Subdivision (1-a) and amending Subdivision (7) to
5656 read as follows:
5757 (1-a) "Cell site information" means information that
5858 reveals the location of a cellular telephone or other wireless
5959 communications device and that is derived from the device's
6060 connections to radio antennas through which a provider of an
6161 electronic communications service or provider of a remote computing
6262 service provides wireless service to that device.
6363 (7) "Electronic customer data" means data or records
6464 that:
6565 (A) are in the possession, care, custody, or
6666 control of a provider of an electronic communications service or
6767 provider of a remote computing service; and
6868 (B) contain:
6969 (i) information revealing the identity of
7070 customers of the applicable service;
7171 (ii) information about a customer's use of
7272 the applicable service;
7373 (iii) information that identifies the
7474 recipient or destination of a wire or electronic communication sent
7575 to or by a customer;
7676 (iv) the content of a wire or electronic
7777 communication sent to or by a customer; [and]
7878 (v) cell site information; and
7979 (vi) any data stored with the applicable
8080 service provider by or on behalf of a customer.
8181 SECTION 4. The changes in law made by this Act apply only to
8282 a warrant issued on or after the effective date of this Act. A
8383 warrant issued before the effective date of this Act is governed by
8484 the law in effect on the date the warrant was issued, and the former
8585 law is continued in effect for that purpose.
8686 SECTION 5. This Act takes effect September 1, 2019.
