66 AN ACT
77 relating to the disclosure to a law enforcement agency of
88 confidential information relating to a complaint filed with the
99 Texas Ethics Commission; creating a criminal offense.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 571.140(a), Government Code, is amended
1212 to read as follows:
1313 (a) Except as provided by Subsection (b) or (b-1) or by
1414 Section 571.1401 or 571.171, proceedings at a preliminary review
1515 hearing performed by the commission, a sworn complaint, and
1616 documents and any additional evidence relating to the processing,
1717 preliminary review, preliminary review hearing, or resolution of a
1818 sworn complaint or motion are confidential and may not be disclosed
1919 unless entered into the record of a formal hearing or a judicial
2020 proceeding, except that a document or statement that was previously
2121 public information remains public information.
2222 SECTION 2. Subchapter E, Chapter 571, Government Code, is
2323 amended by adding Section 571.1401 to read as follows:
2424 Sec. 571.1401. CERTAIN DISCLOSURE OF INFORMATION. (a) The
2525 commission may disclose to a law enforcement agency information
2626 that is confidential under Section 571.140(a) to the extent
2727 necessary for the recipient of the information to perform a duty or
2828 function that is separate from the commission's duties and
2929 functions.
3030 (b) Information disclosed to a law enforcement agency under
3131 this section remains confidential, and the agency receiving the
3232 information shall take appropriate measures to prevent disclosure
3333 of the information.
3434 (c) A person commits an offense if the person discloses
3535 confidential information obtained under this section. An offense
3636 under this subsection is a Class C misdemeanor.
3737 SECTION 3. This Act takes effect September 1, 2019.
