55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prosecution of the criminal offense of sexual
88 assault.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 22.011(b), Penal Code, is amended to
1111 read as follows:
1212 (b) A sexual assault under Subsection (a)(1) is without the
1313 consent of the other person if:
1414 (1) the actor compels the other person to submit or
1515 participate by the use of physical force, violence, or coercion;
1616 (2) the actor compels the other person to submit or
1717 participate by threatening to use force or violence against the
1818 other person or to cause harm to the other person, and the other
1919 person believes that the actor has the present ability to execute
2020 the threat;
2121 (3) the other person has not consented and the actor
2222 knows the other person is:
2323 (A) unconscious;
2424 (B) [or] physically unable to resist; or
2525 (C) physically unable to communicate a lack of
2626 consent because of a debilitating level of fear;
2727 (4) the actor knows that as a result of mental disease
2828 or defect the other person is at the time of the sexual assault
2929 incapable either of appraising the nature of the act or of resisting
3030 it;
3131 (5) the other person has not consented and the actor
3232 knows the other person is unaware that the sexual assault is
3333 occurring;
3434 (6) the actor has intentionally impaired the other
3535 person's power to appraise or control the other person's conduct by
3636 administering any substance without the other person's knowledge;
3737 (7) the actor compels the other person to submit or
3838 participate by threatening to use force or violence against any
3939 person, and the other person believes that the actor has the ability
4040 to execute the threat;
4141 (8) the actor is a public servant who coerces the other
4242 person to submit or participate;
4343 (9) the actor is a mental health services provider [or
4444 a health care services provider] who causes the other person, who is
4545 a patient or former patient of the actor, to submit or participate
4646 by exploiting the other person's emotional dependency on the actor;
4747 (9-a) the actor is a health care services provider who
4848 causes the other person, who is a patient or client or former
4949 patient or client of the actor, to submit or participate by
5050 exploiting the other person's dependency on the actor acting in a
5151 professional capacity as a health care services provider;
5252 (10) the actor is a clergyman who causes the other
5353 person to submit or participate by exploiting the other person's
5454 emotional dependency on the clergyman in the clergyman's
5555 professional character as spiritual adviser; or
5656 (11) the actor is an employee of a facility where the
5757 other person is a resident, unless the employee and resident are
5858 formally or informally married to each other under Chapter 2,
5959 Family Code.
6060 SECTION 2. Section 22.011(c)(3), Penal Code, is amended to
6161 read as follows:
6262 (3) "Health care services provider" means:
6363 (A) a physician licensed under Subtitle B, Title
6464 3, Occupations Code;
6565 (B) a chiropractor licensed under Chapter 201,
6666 Occupations Code;
6767 (C) a physical therapist licensed under Chapter
6868 453, Occupations Code;
6969 (D) a physician assistant licensed under Chapter
7070 204, Occupations Code; [or]
7171 (E) a registered nurse, a vocational nurse, or an
7272 advanced practice nurse licensed under Chapter 301, Occupations
7373 Code; or
7474 (F) a massage therapist licensed under Chapter
7575 455, Occupations Code.
7676 SECTION 3. The changes in law made by this Act apply only to
7777 an offense committed on or after the effective date of this Act. An
7878 offense committed before the effective date of this Act is governed
7979 by the law in effect when the offense was committed, and the former
8080 law is continued in effect for that purpose. For purposes of this
8181 section, an offense was committed before the effective date of this
8282 Act if any element of the offense occurred before that date.
8383 SECTION 4. This Act takes effect September 1, 2019.
