| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter D, Chapter 545, Transportation Code, | |
| 11 | 11 | is amended by adding Section 545.158 to read as follows: | |
| 12 | 12 | Sec. 545.158. CAPTURING IMAGES OF ILLEGAL PASSING OF | |
| 13 | 13 | STATIONARY TOW TRUCK. (a) In this section, "tow truck" has the | |
| 14 | 14 | meaning assigned by Section 545.157. | |
| 15 | 15 | (b) A tow truck operator may install and operate a system | |
| 16 | 16 | that is capable of taking photographic, video, or digital images of | |
| 17 | 17 | vehicles that pass the tow truck in violation of Section 545.157. | |
| 18 | 18 | (c) A law enforcement agency may use the evidence collected | |
| 19 | 19 | under Subsection (b) to: | |
| 20 | 20 | (1) notify the registered owner of a vehicle that the | |
| 21 | 21 | vehicle may have violated Section 545.157; or | |
| 22 | 22 | (2) enforce Section 545.157. | |
| 23 | 23 | SECTION 2. This Act takes effect September 1, 2019. |
