| 7 | 7 | | relating to forms for creating or revoking a transfer on death deed. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 22.020(a), Government Code, is amended |
|---|
| 10 | 10 | | by adding Subdivision (3) to read as follows: |
|---|
| 11 | 11 | | (3) "Transfer on death deed" has the meaning assigned |
|---|
| 12 | 12 | | by Section 114.002, Estates Code. |
|---|
| 13 | 13 | | SECTION 2. Section 22.020(b), Government Code, is amended |
|---|
| 14 | 14 | | to read as follows: |
|---|
| 15 | 15 | | (b) The supreme court shall, as the court considers |
|---|
| 16 | 16 | | appropriate, promulgate: |
|---|
| 17 | 17 | | (1) forms for use by individuals representing |
|---|
| 18 | 18 | | themselves in certain probate matters, including forms for use in: |
|---|
| 19 | 19 | | (A) a small estate affidavit proceeding under |
|---|
| 20 | 20 | | Chapter 205, Estates Code; and |
|---|
| 21 | 21 | | (B) the probate of a will as a muniment of title |
|---|
| 22 | 22 | | under Chapter 257, Estates Code; |
|---|
| 23 | 23 | | (2) a simple will form for: |
|---|
| 24 | 24 | | (A) a married individual with an adult child; |
|---|
| 25 | 25 | | (B) a married individual with a minor child; |
|---|
| 26 | 26 | | (C) a married individual with no children; |
|---|
| 27 | 27 | | (D) an unmarried individual with an adult child; |
|---|
| 28 | 28 | | (E) an unmarried individual with a minor child; |
|---|
| 29 | 29 | | and |
|---|
| 30 | 30 | | (F) an unmarried individual with no children; |
|---|
| 31 | 31 | | (2-a) a form for use to create a transfer on death deed |
|---|
| 32 | 32 | | and a form for use to create an instrument of revocation of a |
|---|
| 33 | 33 | | transfer on death deed under Chapter 114, Estates Code; and |
|---|
| 34 | 34 | | (3) instructions for the proper use of each form or set |
|---|
| 35 | 35 | | of forms. |
|---|
| 36 | 36 | | SECTION 3. The following provisions of the Estates Code are |
|---|
| 37 | 37 | | repealed: |
|---|
| 38 | 38 | | (1) Section 114.002(b); and |
|---|
| 39 | 39 | | (2) Subchapter D, Chapter 114. |
|---|
| 40 | 40 | | SECTION 4. The repeal of Subchapter D, Chapter 114, Estates |
|---|
| 41 | 41 | | Code, by this Act does not affect the validity of a transfer on |
|---|
| 42 | 42 | | death deed or a cancellation of a transfer on death deed executed |
|---|
| 43 | 43 | | before, on, or after the effective date of this Act. |
|---|
| 44 | 44 | | SECTION 5. This Act takes effect September 1, 2019. |
